<br />Federal Emergency Management Agency <br /> <br />. <br />. <br /> <br />. the special mudslide (Le., mudflow) <br />hazard area in preparation for publica- <br />tion of the FffiM, Zone M may be fur- <br />ther refined. <br />Base flood means the flood having a <br />one percent chance of being equalled or <br />exceeded in any given year. <br />Basement" means any area of the <br />building having its floor sUbgrade <br />(below ground level) on all sides. <br />Brear.away wall means a wall that is <br />not part of the structural support of <br />the building and is intended through <br />its design and construction to collapse <br />under specific lateral loading forces, <br />without causing damage to the ele- <br />vated portion of the building or sup- <br />porting foundation system. <br />Building-see structure. <br />Cha.rgeable rates mean the rates es- <br />tablished by the Administrator pursu- <br />ant to section 1308 of the Act for first <br />layer limits of flood inSurance on exist- <br />ing structures. <br />Chief Executive OfltCeT of the commu- <br />nity (CEO) means the official of the <br />community who is charged with the <br />authority to implement and administer <br />laws, ordinances and regulations for <br />that community. <br />Coastal h.igh. hazard area means an <br />area of special flood ha.za.rd extending <br />from offshore to the inland limit of a <br />primary frontal dune along an open <br />coast and any other area subject to <br />high velocity wave action from storms <br />or seismic sources. <br />Community means any State or area <br />or political subdivision thereof, or any <br />Indian tribe or authorized tribal orga- <br />nization, or Alaska Native village or <br />authorized native organization, which <br />has authority to adopt and enforce <br />flood plain management regulations <br />for the areas within its jurisdiction. <br />Contents coverage is the insurance on <br />personal property within an enclosed <br />structure, including the cost of debris <br />removal, and the reasonable cost of re- <br />moval of contents to minimize da.ma.ge. <br />Personal property may be household <br />goods usual or incidental to residential <br />occupancy, or merchandise, furniture, <br />fixtures, machinery, equipment and <br />supplies usual to other than residential <br />occupancies. <br />Criteria means the comprehensive cri- <br />teria for land management and use for <br />flood-prone areas developed under 42 <br /> <br />.'. <br /> <br />~59.1 <br /> <br />U.S.C. 4102 [or the purposes sel; forth in <br />part 60 of this subchapter. <br />Critical feature means an intl~gral and <br />readily identifiable part of a flood pro- <br />tection system, without which the <br />flood protel~tion provided by the entire <br />system wO~lld be compromised. <br />CuTVilinec~r Line means the border on <br />either a FHBM or FffiM t:b.at delin- <br />eates the l,pecial flood, mudslide (Le., <br />mudllow) :l.nd/or flood-related erosion <br />hazard areas and consists of a curved <br />or contour line that follows l,he topog- <br />raphy. <br />Deductible means the fixed amount or <br />percentage of any loss covered by in- <br />surance which is borne by the insured <br />prior to the insurer's liability. <br />Developelt area means an area of a <br />communit:Y' that is: <br />(a) A primarily urbanized, built-up <br />area that is a minimum of 20 contig- <br />uous acre~i, has basic urban i.nfrastruc- <br />ture, including roads, utilities, commu- <br />nications, and public facilities, to sus- <br />tain industrial, residential, and com- <br />mercial ac:tivities, and <br />(1) Within which 75 percent or more <br />of the pa:rcels, tracts, or lots contain <br />commercial, industrial, or residential <br />structure8 or uses; or <br />(2) Is a single parcel, tract, or lot in <br />which 75 percent of the area contains <br />existing commercial or industrial <br />structure:; or uses; or <br />(3) Is a. subdivision developed at a <br />density of at least two residential <br />structures per acre within which 75 <br />percent or more of the lots ,oontain ex- <br />isting re,sidential structures at the <br />time the designation is adopted. <br />(b) An undeveloped single parcel, <br />tract, or lot of less than 20 acres that <br />is contiguous on at least three sides to <br />areas meeting the criteria of paragraph <br />(a) at the time the designation is <br />adopted. <br />(c) A subdivision that is a minimum <br />of 20 contiguous acres that has ob- <br />tained all necessary government ap- <br />provals, provided that the actual <br />"start of construction" of structures <br />has occurred on at least 10 percent of <br />the lots or remaining lots of a subdivi- <br />sion or 10 percent of the maximum <br />building coverage or remaining build- <br />ing covElrage allowed fora. single lot <br />subdivision at the time the designation <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />221 <br />
