EMPLOYMENT OF CERTAIN PERSONS PROHIBI'J~8D <br /> <br />No person under the age of sixteen YE~ars an.d no person who, at the <br />time, is serving sentence in a penal or correctional institution shall <br />be employed on the work covered b;1 this Contract. <br /> <br />8. REGULATIONS PURSU~ TO SO-<::AL>LED "AN'J~I-KICK:BACK ACT'" <br /> <br />The Contractor shall comply with the applicable regulations (a <br />copy of which is attached and herein inco]~orated by reference) of the <br />Secretary of Labor, United States DepartmEmt of Labor, made pursuant to <br />the so-called "Anti-Kickback Act" of June 13, 1934 (L~8 Stat. 948: 62 <br />Stat. 862; Title U.S.C., Section 874: and 'Citle 40 U.S.C., Section 276c), <br />and any amendments or modifications thereof, shall cause appropriate <br />provisions to be inserted in subcontracts to insure compliance therewith <br />by all subcontractors subject the:r:eto, and shall be responsible for the <br />submission of affidavits required by subcontractors thereunder, except <br />as said Secretary of Labor may specifically provide for reasonable <br />limitations, variations, tolerances, and exemptions from the reQuire- <br />ments thereof. <br /> <br />9. EMPLOYMENT OF LA130RERS OR MECHANICS NCY.r LIS:rED IN AFORESAID WAGE <br />DETERMINATION DECISION <br /> <br />Any class of laborers or mechanics which is not listecl in the wage <br />determination and which is to be E3mployed lmd.er the Contract will be <br />classified or reclassified conformably to the wage determination by the <br />Local Public Agency or Public Body, and a report of the action taken <br />shall be submitted by the Local Public Agency' or PubIic Bocly, through <br />the Secreta:rJ of Housing and Urban Development, to the SE'c.retary of <br />Labor, United States Department of Labor. In the event the interested <br />parties cannot . agree on the proper classif:lcation or reclassification <br />of a particular class of laborers and mechanics to be used, the Question <br />accompanied by the recolOInendation of the Local Public Agencw or Public <br />Body shall be refe=ed, through the Secretary of Housing ancl Urban <br />Development, to the Secretary of l:,abor for final determination. <br /> <br />10. FRINGE BENEFITS NOT EXPRESSED AS HOURJ,Y WAGE RATES <br /> <br />The Local Public Agency or Public Body shall require, ,rhenever the <br />minimum wage rate prescribed in the Contract for a class of laborers or <br />mechanics includes a fringe beneHt which .is not expressed as an hourly <br />wage rate and the 'Contractor is obligated to pay cash eQuivalent of such <br />a fringe benefit, an hourly cash E!Quivalent thereof to be Nltablished. <br />In the event the interested partieS cannot agree upon a cash equivalent <br />of the fringe benefit, the Question, accompanied by the recommendation <br />of the Local Public Agency or Public Body, shall. be referred, through <br />the Secretary of Housing and UrbaIl Development, to the Secretary of <br />Labor for determination. <br /> <br />Page 5 of 13 Pages <br /> <br />HUD.4010 (2.76) <br />
