<br />III. 4 <br /> <br />, <br /> <br />in excess of 8 hours or in excess of the standard workweek of 40 hours <br />wi thout payment of the overtime wages reQu.,ired by the clause set forth <br />in paragraph (a). <br /> <br />(c) Withholding- for liquidated damages. The Local Public Agency <br />or Public Body shall withhold or cause to he withheld, from any moneys <br />payable on account of work performed by t1-:.e Contractor or subcontractor, <br />such sums as may administratively be detennined to be necessary to <br />satisfy any liabilities of such Contractor or subcontractor for liQui- <br />dated damages as provided in the elause set forth in paragraph (b). <br /> <br />(d) Subcontracts. The Contractor shall insert in any subcontracts <br />the clauses set forth in paragraphs (a), (ll), and (c) of th:ls Section <br />and also a clause requiring the subcontractors to include these clauses <br />in any lower tier subcontracts wh:lch they nay enter into, together with <br />a clause reQuiring this insertion in any fitrther subcontracts that may <br />in turn be made. <br /> <br />6. 'EMPLOYMENT OF APPRENTICES/TRAINEES <br /> <br />a. Apprentices will be permitted to work at less than the prede- <br />termined rate for the work they performed "hen they are em- <br />ployed and individually registerecl in a bona fide apprentice- <br />ship program registered ,lith the U. S. Department of Labor, <br />Manpower Administration, Bureau of Apprenticeshj.p and Training, <br />or with a State Apprenticeship Ag''llcy reoognized b:y the Bureau, <br />or if a person is employed in his first 90 days of probationar;;r <br />employment as an apprenti.ce in su.ch an apprenticeship program, <br />who is not individually registered in the program, but who has <br />been certified by the Bureau of Apprenticeship and Training or <br />a State Apprenticeship Agency ("here appropriate) to be <br />eligible for probationary employment as an apprentice. The <br />allo"able ratio of apprentices to journeymen in any craft classi- <br />fication shall not be greater than the ratio perm;_Hed to the <br />contractor as to his entire "ork force under the registered, <br />program. Any employee listed on a payroll at an apprentice <br />wage rate, who is not a trainee a,8 defined in subdivision (b) <br />of this subparagraph or is not registered or otherwise employed <br />as stated above, shall be paid the wage rate determined by the <br />Secretary of Labor for the classification of "ork he actually <br />performed.
