<br />e <br /> <br />e <br /> <br />e <br /> <br />FPR 95-395 <br /> <br />COLORADO WATER CONSERVATION BOARD <br />721 State Centennial Building <br />1313 ShermllIl Street <br />Denver, Colorado 80203 <br /> <br />March 13, 1995 <br /> <br />RESOLUTION <br /> <br />WHEREAS, a floodplain information report entitled "Floodplain Information Report, Cucharas <br />River and Tributaries, La Veta, Colorado" dated May 1977 has been prepared by the U.S. Army Corps <br />of Engineers, Albuquerque District; and <br /> <br />WHEREAS, said report includes detailed floodplain information for the Cucharas River and <br />Middle Creek within the corporate boundaries of the Town of La Veta, Colorado, as they were in May <br />1977; and <br /> <br />WHEREAS, the Colorado Water Conservation Board, as requested by the Town of La Veta, <br />Colorado, by Resolution No. 249, adopted on January 16, 1986, designated and approved floodplains <br />in said report; and <br /> <br />WHEREAS, a floodplain information report entitled "Flood Insurance Study, Town of La Veta, <br />Colorado" dated September 1986 has been prepared by the Federal Emergency Management Agency; <br />and <br />WHEREAS, said report includes detailed floodplain information for those portions of the <br />Cucharas River and Middle Creek within the corporate limits of the Town of La Veta, as they were in <br />September 1986; and <br /> <br />WHEREAS, the detailed floodplain information in said report dated September 1986 is consistent <br />with the detailed floodplain information in the report previously designated by Resolution No. 249; and <br /> <br />WHEREAS, the Town of La Veta, Colorado, has requested the Colorado Water Conservation <br />Board to designate llIld approve the floodplains set forth in said report; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the Colorado Water <br />Conservation Board to assist in the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide that <br />legislative bodies of local jurisdictions may provide zoning regulations for IllIld uses on or along any <br />storm or floodwater runoff channel or basin only after designation and approval by the Colorado Water <br />Conservation Board; llIld <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, directs the Colorado Water <br />Conservation Board to designate and approve storm or floodwater runoff channels or basins llIld to make <br />such designations available to legislative bodies of local jurisdictions; and <br />
