RESOLUTION

WHEREAS, a floodplain information report entitled "Floodplain Information Report, Cucharas
River and Tributaries, La Veta, Colorado" dated May 1977 has been prepared by the U.S. Army Corps
of Engineers, Albuquerque District; and

WHEREAS, said report includes detailed floodplain information for the Cucharas River and
Middle Creek within the corporate boundaries of the Town of La Veta, Colorado, as they were in May
1977; and

WHEREAS, the Colorado Water Conservation Board, as requested by the Town of La Veta,
Colorado, by Resolution No. 249, adopted on January 16, 1986, designated and approved floodplains
in said report; and

WHEREAS, a floodplain information report entitled "Flood Insurance Study, Town of La Veta,
Colorado" dated September 1986 has been prepared by the Federal Emergency Management Agency;
and
WHEREAS, said report includes detailed floodplain information for those portions of the
Cucharas River and Middle Creek within the corporate limits of the Town of La Veta, as they were in
September 1986; and

WHEREAS, the detailed floodplain information in said report dated September 1986 is consistent
with the detailed floodplain information in the report previously designated by Resolution No. 249; and

WHEREAS, the Town of La Veta, Colorado, has requested the Colorado Water Conservation
Board to designate llIld approve the floodplains set forth in said report; and

WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the Colorado Water
Conservation Board to assist in the prevention of floods and flood damages therefrom; and

WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide that
legislative bodies of local jurisdictions may provide zoning regulations for IllIld uses on or along any
storm or floodwater runoff channel or basin only after designation and approval by the Colorado Water
Conservation Board; llIld

WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, directs the Colorado Water
Conservation Board to designate and approve storm or floodwater runoff channels or basins llIld to make
such designations available to legislative bodies of local jurisdictions; and
