Box 1458 <br />Fort Collins, Colorado 80522 <br /> <br />Dear Mr. Burns: <br /> <br />This communication is in response to your memorandum of <br />November 5, 1976, directed to this board and the Federal Insurance <br />Administration relating to a floodplain designation in the Big <br />Thompson Canyon. Section 30-28-111(1), CRS 1973, provides in part <br />.'~ as follows: "To the end that adequate safety may be secured, the <br />county planning commission may include in said zoning plan provisions <br />establishing, regulating, and limiting such uses on or along any <br />storm or floodwater runoff channel or basin as such storm or flood- <br />water runoff channel or basin has been designated and approved by <br />the Colorado water conservation board. . . " <br /> <br />The above quoted statute does ,not specifically define the <br />term "floodwater runoff channel','. To clarify this matter, the Water <br />Conservation Board by policy resolutioTh has defined floodwater runoff <br />channel as being that area inundated by the waters of an intermediate <br />regional flood (lOO-year flood). At the request of,this board, the <br />General Assembly later defined a floodplain as an area which is subject <br />to flooding as the result of the occurrence of an intermediate regional <br />flood (24-6,5 .1,-103 (7)), CRS 1973, as amended). <br /> <br />Section 24-65.1-202(2) (a) (I) specific',i'lly directs the Water <br />Conservation Board to promulgate a model floodplain regulation. Sub- <br />p,aragraph (2)(b) states that after promulgation of these guidelines <br />'natural hazard areas shall be administered by local government in a <br />manner which is consistent with the guidelines for land use in each <br />of the natural hazard areas." <br /> <br />Section 24-65.1-402(3) states that "No provHJ.on in this <br />article shall be construed as prohibiting a local government from <br />4Itadopting guidelines or regulations containing requirements which are <br />
