Colorado 80203 <br /> <br />Julv 12. 1994 <br /> <br />RESOLUTION <br /> <br />WHEREAS, Water Resources Consultants, lnc" under contract to the Town ofPoncha Springs, <br />Chaffee County and the Colorado Water Conservation Board, completed a floodplain information report <br />entitled "Floodplain Information Report, South Arkansas RiverIPoncha Creek, Poncha Springs, <br />Colorado" in March 1978; and <br /> <br />WHEREAS, said report includes detailed floodplain information for the South Arkansas River <br />and Poncha Creek; and <br /> <br />WHEREAS, the Colorado Water Conservlltion Board, as requested by the Board of County <br />Commissioners of Chaffee County, by Resolution No, 114, adopted on November I, 1978, designated <br />and approved the floodplains described in said report; and <br /> <br />WHEREAS, a new report entitled "Flood Insurance Study, Town of Poncha Springs, Colorado, <br />Chaffee County", dated February 19, 1987, has been prepared by the Federal Emergency Management <br />Agency; and <br /> <br />WHEREAS, said new report includes detailed floodplain information for those portions of the <br />South Arkansas River and Poncha Creek within the corporate limits of the Town of Panch a Springs, as <br />they were on February 19, 1987; and <br /> <br />WHEREAS, the detailed information contailled in said new report is consistent with the detailed <br />infonnation contained in the report previously designated by Resolution No, 114; and <br /> <br />WHEREAS, the Town of Poncha Springs, Colorado, has requested the Colorado Water <br />Conservation Board to designate and approve the floodplains set forth in the aforesaid new report; and <br /> <br />WHEREAS, the Town of Poncha Springs, Colorado, has not requested the Colorado Water <br />Conservation Board to rescind any portion of Resolution No, 114; and <br /> <br />WHEREAS, Section 37-60-106(l)(c), Colorado Revised Statutes, requires the Colorado Water <br />Conservation Board to assist in the prevention of floods and flood damages therefrom; alld <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide that <br />legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along any <br />storm or floodwater runoff channel or basin only after designation and approval by the Colorado Water <br />Conservation Board; and <br />
