<br />1.18 NEWS RELEASES: News release pertaining to this RFP shall NOT be made prior to execution of a contract. <br />and then are to be made only with the approval of the Department. <br /> <br />1.19 CERTIFICA nON OF INDEPENDENT PRICE DETERMINA nON: <br />A, By submission of this proposal each offeror certifies. and in the case of a joint proposal, each party, <br />thereto certifies as to its own organization. that in connection with this procurement: <br /> <br />(1) <br /> <br />(2) <br /> <br />(3) <br /> <br />The prices in this proposal have been arrived at independently without consultation, <br />communication or agreement. for the purpose of restricting competition. as to any matter relating <br />to such prices with any other offeror or with any competitIOn; <br />Unless otherwise required by law. the prices which have been quoted in this/roposal have not <br />been knowingly disclosed by the offeror and will not knowingly be disclose by the offeror prior <br />to opening, directly or indirectly to any other offeror or to any competition; and, <br />No attempt has been made or will be made by the offeror to induce any other person or firm to <br />submit or not. to submit a proposal for the purpose of restricting competition. <br /> <br />(1) <br /> <br />B, Each person signing the Request For Proposal farm of this RFP certifies that: <br /> <br />(2) <br /> <br />He/She is the person in the offeror's organization responsible within that organization for the <br />decision as to the prices being offered herein and that he/she has not participated. and will not <br />participate, in any action contrary to A(1) through A(3) above; or, <br />He/She is not the person in the offeror's organization responsible within that organization for the <br />decision as to the prices being offered herem but that he/she has been authorized in writing to act <br />as agent for the persons responsible for such decision in certifyin& that such persons have not <br />participated. and will not participate, in any action contrary to A(l) through A(3) above. <br /> <br />A proposal will not be considered far award where A(1). A(3), or B above has been deleted or modified. <br />Where A(2) above has been deleted or modified, the proposal will not be considered far award unless the <br />offeror furnishes with the proposal a signed statement which sets forth in detail the circumstances of the <br />disclosure and tlle lIead of tlle agency or lIis designee, determines tllat sucll disclosure was not made for <br />tlle purpose of restricting competition. <br /> <br />c. <br /> <br />TAXES: The State of Colorado, as purcllaser, is exempt from all Federal taxes under ClIapter 32 of tlle Internal <br />Revenue Code (Registration No. 84-730123K) and from all State and Local Government Use Taxes (Ref. <br />Colorado Revised Statues ClIapter 39-26.114(a). Seller is lIereby notified tllat wllen materials are purchased in <br />certain political subdivisions the seller may be required to pay sales or use tax even though the ultimate product <br />or service is provided to the State of Colorado. This sales tax will not be reimbursed by the State. <br /> <br />1.20 <br /> <br />A VAILABILITY OF RiNDS: Financial obligations of the Stare payable after the current fiscal vear are <br />contingent upon funds for that purpose being appropriated, budgeted. and otherwise made available. In the event <br />funds are not appropriated. any resulting contract wlll become null and void, without penalty to tlle State of <br />Colorado. <br /> <br />1.21 <br /> <br />1.22 <br /> <br />PROVISION FOR REOUIRED INSURANCE: Award of a contract will be contingent upon the successful <br />~roposer submitting certificates of insurance in accordance with the provisions as outlined in Section 2.20 <br />'INSURANCE". <br />
