Proposals will not be accepted by facsimile transmittal or e-mail. Proposers are advised that the Department requests proposals prepared in response to this RFP be submitted on recycled paper. and that all copies be printed on both sides of paper. While the appearance of proposals is important. and professionalism in proposallresentation should not be neglected. the use of non-recyclable or non-recycled glossy material is discourage . In addition, it is requested that proposals be in flat bound form to facilitate filing. Please do not submit proposals in loose-leaf binders, All proposals must include the RFP PDA- 0133-Cherry Crk Bid Sheet, Exhibit B. 1.5 INOUIRIES: Prospective proposers may make written inquiries concerning this RFP to obtain clarification of requirements. No in~uiries will be accepted after the date and time specified in the Schedule of Activities, Prospective Proposer s Inquiry Deadline. Inquiries sent by fax will be accepted (FAX number [303J 866-5575). An addendum will be posted on the State's "B.LDS' (electronic bid notification and distribution system) and will respond to all questions submitted regarding the RFP. 1.6 A,1v1ENDMENTS TO RFP: In the event it should be necessarv to revise anv portion of this RFP. addenda will be posted on the State's B.LD.S. system. If you received this RFP by means other than direct mail from DNR or the B.LD.S, system, you must furnish your firm's name. address and telephone number to the DNR Purchasing Agent identified above In order to receive any addenda to this RFP. 1.7 RESPONSE MA TERLAl OWNERSHIP: All proposals become the property of the State of Cc' orado upon receipt and will only be returned to the proposer at the State's option. Selection or rejection of the proposer wiil not aifect this right. The State shall have the right to use all ideas or adaptation of ideas contained in any proposal received in response to this RFP. subject to limitation outlined in the section entitled Proprietary Information. Disqualification of a proposal does not eliminate this right. 1.8 PROPRIETARY J]\J1'ORMATION: All material submitted in response to this RFP will become public record and will be subject to inspection after an intent to award notice is issued. Any material requested to be treated as proprietary or confidential must be clearly identified and easily separable from the rest of the proposal. Such request must include justification for the request. The request will be reviewed and either approved or denied by the Department's Purchasing Director. If denied. the proposer will have the opportunitv to withdraw its entire proposal. or to remove the proprietary restrictions, Neither cost nor pricing information nor a total proposal will be considered proprietary. 1.9 REJECTION OF PROPOSALS: The State .of Colorado reserves the right to reject any or all proposals received in response to thIS RFP. or to cancel the RFP If It IS In the best Interest o(the State to do so. Failure to furnish all information or to follow the proposal format requested in the RFP may disqualify the proposal. Any exceptions to the scope of work must be IdentIfied In the proposal. INClJRRI1\IG COST: The Department shall not be obligated or liable for anv cost incurred by proposers prior to issuance of a contract. All costs to prepare and submit a response to this solicitation shall be borne by the proposer.
