<br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised <br />Statutes 1973, provide that such legislative bodies of local <br />jurisdictions may provide zoning regulations for land uses on or <br />along any storm or floodwater runoff channel or basin only after <br />designation and approval by the Colorado Water Conservation <br />Board; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes <br />1973, directs the Colorado Water Conservation Board to designate <br />and approve storm or floodwatel;' runoff channels or basins and to <br />make such designations available to legislative bodies of local <br />jurisdictions: and <br /> <br />WHEREAS, the staff of th'i! Board has reviewed said revised <br />information and data and does hereby recommend to the Colorado <br />Water Conservation Board that the Board designate and approve as <br />floodplain areas those areas inundated by a 100-year flood <br />(intermediate regional flood) as described by the floodwater <br />surface elevations and profiles in said new report, and further <br />recommends that the floodplatn designations for the Colorado <br />River, Leach Creek, and the Horizon Drive Channel within the <br />corporate limits of the City of Grand Junction on July 6, 1982, <br />as approved by resolution No. 79, adopted September 23, 1977, be <br />rescinded; <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Colorado Water Conser- <br />vation Board in reg ular meeti.ng assembled in Denver, Colorado, <br />this 7th day of January, 1983, that it does hereby designate and <br />approve as floodplain areas those areas described as being <br />inundated by a 100-year flood as described by the floodwater <br />surface elevations and profiles in said new report, dated July 6, <br />1982, and does hereby rescind those said portions of resolution <br />Nos. 25 and 79, dated October 31, 1973, and September 23, 1977, <br />respectively: and <br /> <br />BE IT FURTHER RESOLVED that the Secretary of the Board is <br />directed to send a certified ~opy of this resolution to the City <br />of Grand Junction: the Board of County Commissioners of Mesa <br />County; the U.S. Army Corps of Engineers, Sacramento District; <br />and the Federal Emergency Management Agency. <br /> <br />CERTIFICATE <br /> <br />I certify that the foregOing is a true and correct copy of a <br />resolution adopted by a majority vote of the members of the <br />Colorado Water Conservation Board in regular session assembled at <br />Denver, Colorado, on the 7th day of January, 1983, at which a <br />quorum was present. <br /> <br />
