<br />floodprone various areas within the corporate limits of the City of Colorado Springs, as they were <br />on February 16, 1990, which incorrect information was rescinded by Resolution No. 96-416; and <br /> <br />WHEREAS, said new report for the City of Colorado Springs dated February 16, 1990 <br />provides, on the basis of completed flood control improvements and hydraulic analyses that were <br />approved by the Federal Emergency Management Agency as part of a Letter of Map. Revision <br />(LOMR), detailed floodplain information which revises detailed floodplain information previously <br />designated and approved by Resolution No. 264 3l1d acknowledged by Resolution No. 96-416 for <br />the following stream reach listed in Table 1, atulched hereto and by this reference incorporated <br />herein: <br /> <br />TABLE 1 <br /> <br />Detailed Information Revised By a LOMR <br /> <br />Sand Creek East Fork extending from the crossing ofPowers Boulevard upstream to a point approximately 2850 <br />feet upstream of the crossing of Powers Boulevard <br /> <br />; and <br /> <br />WHEREAS, the Board is taking this action under the provisions of Rule 9.D.2. of the <br />Board's "Rules and Regulations for the Designafion and Approval of Floodplains and of Storm <br />or Floodwater Runoff Channels in Colorado" (2 CCR 408-1), (Board Initiative), and the City of <br />Colorado Springs and the EI Paso Regional Building Department have been notified and their <br />comments have been considered in this resolution; and <br /> <br />WHEREAS, the City of Colorado Springs, Colorado, has sent a letter requesting the <br />Colorado Water Conservation to designate and approve the floodplains set forth in the aforesaid <br />new report which was dated after the deadline of 30 days prior to this Board meeting; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the Colorado <br />Water Conservation Board to assist in the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide that <br />legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along <br />any storm or floodwater runoff channel or basin only after designation and approval by the <br />Colorado Water Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, directs the Colorado <br />Water Conservation Board to designate and approve storm or floodwater runoff channels or <br />basins and to make such designations available to legislative bodies of local jurisdictions; and <br /> <br />WHEREAS, the information in said neW report for the stream reach listed in Table 1 <br /> <br />4 <br />
