Contract Encumbrance Number and <br /> <br />WHEREAS. required approval. clearance and coordinalion has been accomplished from and with appropriate <br />agencies; and <br /> <br />WHEREAS." Section 37-60-106(1) (c), Colorado Revised statutes 1973, <br />as amended, directs the Colorado Water conservation Board to devise <br />and formulate methOds, means, and plans for bringing about the <br />greater utilization of the waters of the state and the prevention of <br />flood damages therefrom, to designate and approve storm Or flood- <br />water runoff channels Or basins and to make such designations avail- <br />able to legislative bodies of cities and incorporated towns, to <br />county planning commissions, and to. boards of adjustment of cities, <br />incorporated towns, and counties of this state; and <br /> <br />WHEREAS, Canon city and Fremont County have previously contracted <br />with the contractor for a floodplain information stud~ On the NE <br />Canyon Drainage Area in and near Canon city, Colorado, and <br /> <br />WHEREAS, Canon city and Fremont County have requested the state's <br />assistance in the preparation of the floodplain information study; <br />and <br /> <br />WHEREAS, the state has adopted a policy whereby direct financial <br />and technical assistance is available for the delineation of flood <br />/ areas and the prevention of flood damages; and <br /> <br />WHEREAS, Canon city and Fremont County have cost-shared in the <br />floodplain information study in the amount of Four Thousand One <br />Hundred Dollars ($4,100) and have provided detailed topographic <br />mapping at a cost in excess of Five Thousand Dollars ($5,000); and <br /> <br />WHEREAS, the Contractor is a prOfessional engineering firm with <br />employees registered in the state of COlorado and is experienced and <br />qualified in preparing hydrologic and hydraulic analyses and flood- <br />plain information studies; and <br /> <br />WHEREAS, the contractor is an independent contractor and as such <br />is not entitled to any benefits of the state personnel system; <br /> <br />NOW, THEREFORE, it is hereby agreed that <br /> <br />1. The Contractor shall complete the floodplain information study <br />outlined in the following documents by March I, 1981: <br /> <br />a. Letter of request for time and cost proposal, dated August 15', <br />1980, which documen~ is attached hereto as Appendix A and <br />made a part of this contract. <br /> <br />b. Proposal to provide engineering services prepared by Great.( <br />Divide Engineering and Surveying, dated Spetember 4, 1980,' <br />which document is attached hereto as Appendix B and made a <br />part of this contract. <br /> <br />2.
