A "payment bond" is one executed in connectlon with a contractor to assure payment as required by law of all persons supplying labor and material in the execution of the work provided for in the contract. (Section 38-26-105). b. (Section 38-26-106). The bonds shall be obtained from companies holding certificates of authority as acceptable sureties. A certified or cashier's check or a bank money order may be accepted in lieu of a bond. Exhibit VIII-10 provides a sample form of both payment and performance bonds. 16. WAGES AND SALARIES a. Attention of Bidders is particularly called to the requirements con- cerning the payment of not less than the prevail ing wage and salary rates specified in the Contract Documents and the conditions of employment with res- pect to certain categories and classifications of employees. b. The rates of pay set forth under GENERAL CONDITIONS are the mlnlmums to be paid during the life of the Contract. It is therefore the responsibility of Bi dders to inform themse1 ves as to Davi s-Bacon requi rements as well as to the local labor conditions such as the length of work day and work week, over- time compensation, health and welfare contributions, labor supply and prospec- tive changes or adjustments of rates. 17. EQUAL ErWlOYMENT OPPORTUNITY Attention of Bidders is particularly called to the requirement for ensur- ing that employees and applicants for employment are not discriminated against because of their race, color, religion, sex, or national origin. The contractor will be required to take affirmative action to ensure that employees and applicants for employment are not discriminated against. 18. "SECTION 3" COMPLIANCE IN THE PROVISION OF TRAINING, EMPLOYMENT AND BUSINESS OPPORTUNITIES Attention of bidders is particularly called to the so-called Section 3 provisions which require that, to the greatest extent feasible, opportunities for training and employment be given to lower-income residents of the project area and contracts for work in connection with the project be awarded to business concerns which are located in or owned in substantial part by persons residing in the project area. 00100-5
