Development Act of 1974. <br /> <br />No person in the Uni ted States shall on the ground of race, color, <br />national origin, or sex be excluded from participation in, be denied the <br />benefits of, or be sUbjected to discrimination under any program or <br />activity funded in whole or in part with funds mClde available under this <br />title. <br /> <br />7. "Section 3" Compliance in the Provhion of T1"aining, Employment and <br />Business Opportunities. <br /> <br />a. The work to be performed under thh contract is on a project assi sted <br />under a program providing direct federal fiinancia1 assistance from <br />the Department of Housing and Urban Development and is subject to the <br />requirements of Section 3 of the Housing and Urban Ove10pment Act of <br />1968, as amended, 12 U.S.C. 1701u. Section 3 requires tt.at, to the <br />greatest extent feasible, opportunities for training and employment <br />be given lower income residents of the project area, and contracts <br />for work in connection with the project be awarded to business <br />concerns which are located in or mined in substantial part by persons <br />residing in the project area. <br /> <br />b. The parties to this contract will comply with the provisions of saio <br />Section 3. The parties to this contract certify and agree that they <br />are under no contractual or other disabili~y which would prevent them <br />from complying with these requirements. <br /> <br />c. The contractor will send to each 1 abor organi' zati on or representati ve <br />of workers with which he has a collective bargaining agreement or <br />other contract or understanding, if any, a InOtice advising the said <br />labor or~anization or workers; representative of his responsibilities <br />under tIlls Section 3 requirement and shall post copies of the notice <br />in conspicuous places available to employees and applicants for <br />employment or training. <br /> <br />d. The contractor will include these Section 3 provlslons in every <br />subcontract for work in connection with the project and will, at the <br />direction of the app1 icant for or recipient of federal financi a1 <br />assi stance, take appropri ate acti on pursuant to the subcontract upon <br />a fi ndi ng that the subcontractor is not maki ng a good faitl, effort to <br />comply with these Section :is requirements. The contractor will not <br />subcontract with any subcontractor where it has notice or know1eage <br />that the latter has been found to Ilave previously not made a good <br />faitll effort to comply l/tth these Section 3 rlequirements. <br /> <br />00530-:> <br />
