<br />process is applicable are provided in the
<br />following portion of this chapter. The chart
<br />shown in Figure 2 summarizes the information
<br />provided in Steps 1 and 2 and may be used as a
<br />guide for choosing the appropriate process.
<br />
<br />Step 2--Selecting a Revision
<br />Process
<br />
<br />More-detailed information about each process,
<br />including the types and amounts of data that
<br />you must submit, are provided in Chapters 3, 4,
<br />S, 6, and 7. This Guide is applicable only to
<br />changes that may be made under the Appeal,
<br />Map Revision, Conditional Map Revision, and
<br />Map Amendment processes. If the conditions
<br />under which a change is to be made are not the
<br />same as those specified for one of the four
<br />processes described in this section, you should
<br />discuss the requested change with a
<br />representative of the appropriate FEMA
<br />Regional Office.
<br />
<br />Appeals (Part 67). Under Title 44, Chapter I,
<br />Part 67, CFR, Appeals are defined as requests for
<br />changes to proposed BFEs. To qualify as
<br />Appeals, such requests must be submitted to
<br />FEMA during the formal 90-day appeal period
<br />and must be supported by data that show that
<br />the proposed BFEs are either scientifically or
<br />technically incorrect.
<br />
<br />A formal 90-day appeal period is provided to a
<br />community only when new or revised BFEs are
<br />being proposed for the community and may
<br />therefore be required in only two situations: (1)
<br />when a community is being converted to the
<br />Regular Phase of the NFIP with a FIRM that
<br />presents new BFEs or (2) when the BFEs shown
<br />on an effective FIRM for a community are being
<br />revised by an RFIS or through the Map Revision
<br />process.
<br />
<br />Because BFEs are not shown on FHBMs, the
<br />appeal process applies only to FIRMs. In
<br />addition, although changes to map information
<br />other than proposed BFEs (e.g., floodplain
<br />boundaries, floodway boundaries, flood
<br />insurance rate zones) may be necessary as part of
<br />the resolution of an Appeal, requests that do
<br />not involve BFEs do not qualify as Appeals.
<br />Requests of this type, when submitted during
<br />the 90-day appeal period, are called Protests.
<br />
<br />The FEMA policy concerning the processing of
<br />Protests is discussed in Appendix A.
<br />
<br />Map Revisions (Part 65). Under Title 44,
<br />Chapter I, Part 6S, CFR, changes may be made to
<br />the information depicted on effective FHBMs,
<br />FIRMs, and FBFMs. Changes to floodplain
<br />boundaries, floodway boundaries, flood
<br />insurance rate zones, BFEs, flood depths, and
<br />other information shown on the maps may be
<br />requested under this process.
<br />
<br />Such changes may be based only on eXisting
<br />conditions; in general, the effects of proposed
<br />projects and future floodplain or watershed
<br />conditions cannot be shown on NFIP maps and,
<br />therefore, do not warrant map revisions. Refer
<br />to Chapter 4, "Map Revisions", for information
<br />about exceptions to this general rule.
<br />
<br />Occasionally, because of the limitations of the
<br />scale at which NFIP maps are prepared, the SFHA
<br />boundaries cannot accurately reflect the
<br />existence of individual structures or small parcels
<br />of land that are above the BFE. This situation
<br />can occur when fill has been placed to elevate
<br />the structure or parcel or when the structure or
<br />parcel is on unaltered high ground.
<br />
<br />Although such structures and parcels of land can
<br />be removed from the SFHA, the process by which
<br />they are removed depends on whether fill was
<br />placed and when. If the structure or parcel of
<br />land is elevated by fill placed after the effective
<br />date of the first NFIP map that showed the
<br />property to be within the SFHA, the request is
<br />processed as a request for a map revision.
<br />Where fill has not been placed, or was placed
<br />before that date, the structure or parcel is
<br />considered to have been inadvertently included
<br />in the SFHA and the request is processed as a
<br />request for a Map Amendment (Part 70).
<br />
<br />Requests for the removal of structures or parcels
<br />of land inadvertently included in both the SFHA
<br />and regulatory floodway are always processed as
<br />requests for Map Revisions.
<br />
<br />Conditional Map Revisions (Part 72).
<br />Under Title 44, Chapter I, Part 72, CFR, FEMA
<br />may issue a conditional determination regarding
<br />the effects of proposed projects, such as
<br />modifications of stream channels and
<br />floodplains, and the proposed elevation of
<br />
