COVERAGE UNDER THIS GENER/oL PERMIT <br /> <br />Under this general permit, operators of "tc rmwater discharges associated with construction activity may be granted <br />authorization to discharge stormwater in:o waters of the State of Colorado. This includes stormwater discharges <br />associated with industrial activity from are:zs that are dedicated to producing eanhfn materials, such as soils, sand and <br />gravel, for use at a single ~onstruction site and dedicated asphalt plants and dedicated concrete plants. <br /> <br />This permit does not pre-empt aT sUf ersede the authority of local agencies to prohibit, restrict or control discharges of <br />stormwater to storm drain .;ystems or other water courses within their jurisdiction. <br /> <br />Authorization to discharge .ndeT the pen"ii requires submittal of a completed application form and a cenification that the <br />SJ.l.MP is complete. Upon 'eceipt of all J'e<j'uired iriformation, the Division may allow or disallow coverage under the <br />general permit. <br /> <br />V. APPLICATION AND CERTlFICATIOIV <br /> <br />At least ten days prior to the anticipc!ted dc:te of discharge, the operator of the consrruction site shall submit an original <br />completed application which includes the signfd cenijication that the SJ.l.MP is complete. In order to avoid confusion <br />during processing, original signature.; are required for the application to be considered complete. <br /> <br />For the purpose of this permit, the "opemtc r" is the person who has day-to-day conlrol over the project. This can be the <br />owner, the developer, the general contractor or the agent of one of these panies. in some circumstances. At different <br />times of a construction project, different tYf es of panies may satisfy the definition of 'operator' and the cenification may <br />be transferred as roles change. <br /> <br />(Note - Under the Federal regulations, th,s :zpplication process is Teferred to as a Notice of Intent, or NOI. ") An outline of the permit <br />application requirements is found in the pmnit at Pan I.A.3.b. <br /> <br />If this general permit is applicable, then C' cmification will be developed and the applicant will be cenified under this <br />general pennit. <br /> <br />VI. TERMS AND CONDITIONS OF PERMIT <br /> <br />A. Stormwater Manal!ement Plans (SW~I~ <br /> <br />Prior to commencement of construction, a stormwater management plan (SWMP) shall be developed and <br />implemented for each faCility covered b)' this permit. A cenification that the SJ.l.MP is complete must be submitted <br />with the permit application. The SWMP shall identify potential sources of pollution (including sediment) which may <br />reasonably be expected to affecr the q,,,ality of storm water discharges associated with construction activity from the <br />facility. In addition, the plan shall describe the best management practice (BMPs) which will be used to reduce the <br />pollutants in stormwa!er discharges from the construction site. Facilities must implement the provisions of their <br />SJ.l.MP as a condition of this pennit. ;"lIe SJ.l.MP shall include the fallowing iten1S: <br /> <br />I. Site Description <br /> <br />2.
