Dutv to Provide Infllnnation <br /> <br />The permittee shall fllrnish to the Di" ision. within a reasonable time, any infoIDlation which the Division may <br />request to detetmine whether cause el;ists fot modifying, revoking and teissuing, or inactivating coverage under this <br />permit, or to determi.le compliance ~.ith this permit. The permittee shall also furnish to the Division, upon request, <br />copies of records reg Jired to b, kept by thIS permit. <br /> <br />3. Transfer of Ownership or Control <br /> <br />Certification undet ths petmit may be transferred to a new permittee if: <br /> <br />a) The current pe:'mittee notifie, 111e Division in writing when the transfer is desited; and <br />b) The notice includes a wtitten agreement between the existing and new petmittees containing a specific date fot <br />transfet of permit tesponsibilit)', coverage and liability between them; and <br />c) The current pe:'mittee has met all fee tequirements of the State Discl1arge Permit System Regulations, Section <br />6.16.0. <br /> <br />4. Modification. Suspension, or Revoc"tion of Pennit Bv Division <br /> <br />All permit modificat,,)n, inactivation or tevocation and reissuance actions shall be subject to the tequirements of the <br />State Discharge Permit System Regul.'tions, Sections 6.6.2, 6.6.3, 6.8.0 and 6.16.0, 5 C.C.R. 1002-2, except for <br />minor modifications. <br /> <br />a) This permit, and certification mder this permit, may be modified, susp,:nded, Ot revoked in whole Ot in pan <br />during its term for teasons determined by the Division including, but not limited to, the following: <br /> <br />I) Violation of an)' terms (It ,:onditions of the permit; <br /> <br />2) Obtaining a permit by misrepresentation or failing to disclose any fact which is material to the granting Ot <br />denial of a permit or to th,: establishment of terms or conditions of the permit; <br /> <br />3) Materially false Ot :nac(:urate statements Ot information in the application fot the permit; <br /> <br />4) Promulgation of to,.ic e:'flllent standards or prohibitions (including any schedule of compliance specified <br />in such effluent startdard et prohibition) which are established und,:r Section 307 of the Clean Water Act, <br />where suel1 a toxic polhlll,m is present in the discharge and such slandard or prohibition is more stringent <br />than any limitation for weh pollutant in this permit. <br /> <br />b) This permit, or certification uLder this permit, may be modified in whole Ot in pan due to a change in any <br />condition that requires either a tempotary Ot permanent teduction or elimination of the permitted discharge, <br />such as: <br /> <br />1) Promulgation of Water Quality Standards applicable to waters affected by the permitted discharge: or <br /> <br />2) Effluent ltmitations or Nh:r requirements applicable pursuant to the State Act or federal tequirements; or <br /> <br />3) Control tegulations prOlDlllgated; or <br /> <br />4) Data submitted pur:man: to Pan I.B or Pan I.C.2 indicates a potential fot violation of adopted Water <br />Quality Sl.andards cr stream classifications. <br /> <br />c) This permit, or certifical.ion ",:der this permit, may be modified in whole or in pan to include new effluent <br />limitations ami other approp:~ia.te conditions where data submitted pursuant to Part I.B.3 indicates that such <br />
