<br />C. Floodplain Administrator's Responsibility in Appeals to <br />the Board <br />If an applicant decides to appeal a denied permit, the floodplain <br />administrator assists the applicant in filling out the appeal form, and <br />files it with the Board of Adjustment. <br />Hearings before the Board are similar to a court trial, with sworn wit- <br />nesses and decisions based on the evidence and specific standards, <br />although the parties are not required to be represented by attorneys. <br />Because of the quasi-judicial nature of the appeal procedure, the flood- <br />plain administrator must be sure that the appeal application is complete, <br />The floodplain administrator must provide the entire file concerning the <br />case, including the following information: <br />a, Application number <br />b, Location of premises <br />c, Type of structure or use <br />d, Zoning administrator's reasons for denial <br />e, Section of ordinance <br />f, Zoning district involved <br />g, Action requested by application (variance, special exception, <br />interpretation) <br />h, Reasons why the request should be granted (from application) <br />The Board of Adjustment may delegate the notification respon- <br />sibilities to the floodplain administrator, The Board may also request the <br />floodplain administrator to testify at the hearing, <br />In summary, once a permit is denied, the floodplain administrator is <br />always required to: <br />a, Advise applicant of the right to appeal, <br />b, Assist applicant with filling out the necessary forms. <br />c, File the information with the Board of Adjustment. <br />The floodplain administrator is usually required to: <br />a Have the hearing notice published, <br />b, Distribute the hearing notice to parties in interest. <br />c. Present facts at the hearing, <br /> <br />C' <br /> <br />{' <br /> <br />D. Special Exception Permits and Amendments <br />The floodpiain administrator has little responSibility in the special <br />exception permit or the amendment procedures beyond advising the <br />applicant of the proper course of action to take, and forwarding the <br />applications to the proper governing body, <br /> <br />I <br />" <br /> <br />18 <br />
