e e L": e I [ GC.34 GC-35 GC-36 The CONTRACTOR shall also indemnify and hold harmless the OWNER, the ENGINEER, the OWNER's Representative, and their consultants, and each of their director, officers, employees, and agents from and against all losses, expenses, damages including damages in the WORK itself, attorney's fees, and other costs, including all costs of defense, which any of them may incur with respect to the failure, neglect, or refusal of CONTRACTOR to faithfully perform the work and all of the CONTRACTOR's obligation under the CONTRACT. Such costs, expenses, and damages shall include all cost, including attorneys' fees, incurred by the indemnified parties in any lawsuit in which they are a parry. SEPARATE CONTRACTS. The OWNER reserves the right to let other contracts in connection with this PROJECT. The CONTRACTOR shall afford other CONTRACTORS reasonable opportunity for the introduction and storage of their materials and the execution of their WORK, and shall properly connect and coordinate his WORK with theirs. If the proper execution or results of any part of the CONTRACTOR's WORK depends upon the WORK of any other CONTRACTOR, the CONTRACTOR shall inspect and promptly report to the ENGINEER any defects in such WORK that render it unsuitable for such proper execution and results. . The OWNER may perform additional WORK related to the PROJECT by itself, or it may let other contracts containing provisions similar to these. The CONTRACTOR will afford the other CONTRACTORS who are parties to such CONTRACTS (or the OWNER), reasonable opportUnity for the introduction and storage of materials and equipment and the execution of WORK, and shall properly connect and coordinate his WORK with theirs. If the performance of additional WORK by other CONTRACTORS or the OWNER, is not noted in the CONTRACT DOCUMENTS prior to the execution of the CONTRACT, written notice thereof shall be given to the CONTRACTOR prior to starting any such additional WORK. If the CONTRACTOR believes that the performance of such additional WORK by the OWNER or others involves him in additional expense or entitles him to an extension of the CONTRACT TIME, he may make a claim therefor as provided elsewhere in these General Conditions. CONTRACTOR'S GUARANTEE. The CONTRACTOR shall guarantee all materials and equipment furnished and WORK performed for a period of one (1) year from the date of final acceptance stipulated in General Condition GC-28 for all WORK performed under the terms of this CONTRACT. The CONTRACTOR shall further warrant and guarantee for a period 01' one (1) year from date of final acceptance that all WORK is free from all defects due to faulty materials or workmanship. The CONTRACTOR shall promptly make such corrections as may be necessary by reason of such defects including the repairs of any damage to other parts of the system resulting from such defects. The OWNER will give notice of observed defects with reasonable promptness. In the event that the CONTRACTOR should fail to make such repairs, adjustments, or other WORK that may be made necessary by such defects, the OWNER may do so and charge the CONTRACTOR the cost thereby incurred. The Performance BOND shall remain in full force and effect through the guarantee period. PERFORMANCE DURING GUARANTEE PERIOD. The OWNER will observe a standard procedure to request performance by the CONTRACTOR for WORK covered by the Guarantee. The OWNER will inform the CONTRACTOR of the defects of which it complains, and the CONTRACTOR shall within ten days begin the work of repair or replacement. Should the CONTRACTOR fail to begin such WORK within ten days. the OWNER may make the repairs or replacements at the expense of the CONTRACTOR. If the OWNER determines that III-26 (1723 - lO/93)
