Should the CONTRACTOR <br />fail to satisfy all requirements for licensing and fail to satisfy all requirements for <br />permits, the OWNER may withhold all or parts of progress payments. <br /> <br />d. <br /> <br />FAILURE TO COMPLY WITH APPLICABLE LAWS. The OWNER may withhold <br />all or parts of progress payments if the CONTRACTOR has failed to comply with all <br />applicable laws, ordinances, rules, and regulations. <br /> <br />e. <br /> <br />FAILURE TO MAINTAIN AN ADEQUATE RATE OF PROGRESS. <br />FAILURE TO MAINTAIN A CLEAN AND ORDERLY WORK SITE. <br /> <br />f. <br /> <br />g. <br /> <br />FAlLURE TO SATISFACTORILY REPLACE AND/OR REPAIR PROPERTY <br />DESTROYED OR DAMAGED DURING THE PROGRESS OF THE WORK. <br /> <br />PARTIAL ACCEPTANCE OF WORK. The OWNER may place into service segments or <br />. .parts of the WORK before the entire WORK has been completed. Because of the difficulty <br />of determining when the CONTRACTOR's responsibility for various parts of the WORK might <br />cease when that WORK is partly used by the OWNER, the CONTRACTOR agrees that, except <br />as qualified below, his responsibility for the entire WORK shall not diminish until the OWNER <br />accepts the entire and completed WORK. <br /> <br />If such early use or occupancy by the OWNER exposes defects, the components or elements <br />of the WORK with the defects will be replaced or repaired by the CONTRACTOR. Other <br />damages or wear resulting from the OWNER's use will be at the OWNER's expense. <br /> <br />When the OWNER partially occupies a facility, it will share with the CONTRACTOR the costs <br />of energy to heat and light the facility and the costs of water and sanitary sewer service. The <br />OWNER's share of these costs will be determined by the OWNER on an equitable basis, and <br />the CONTRACTOR will be reimbursed by a CHANGE ORDER. <br /> <br />CLEAN-UP UPON COMPLETION. Upon completion of the WORK, the CONTRACTOR <br />shall, as soon as practicable, remove all waste materials, excess materials, tools, and equipment <br />such as scaffolding, temporary structures, and facilities such as fencing and sanitary facilities. <br /> <br />Upon completion of WORK on structures designed for human occupancy, the CONTRACTOR <br />shall clean and replace broken or scratched windows, clean and repair all snrfaces, and clean <br />and adjust all units of equipment which are part of the various building systems. <br /> <br />The completed WORK must be ready for full use before it is given a final inspection. Final <br />payment will not be made to the CONTRACTOR until all clean-up is done to the satisfaction <br />of the ENGINEER and the OWNER. <br /> <br />COMPLETION AND ACCEPTANCE OF THE WORK. Upon written notification from the <br />CONTRACTOR that the WORK is complete, the ENGINEER will by inspection, examination, <br />and test confirm that the WORK has been fully completed in accordance with the DRAWINGS, <br />SPECIFICATIONS, and CONTRACT DOCUMENTS. When the ENGINEER is satisfied that <br />the WORK is, in fact, complete, the ENGINEER will recommend to the OWNER that the <br />WORK be accepted. If the OWNER agrees with the recommendation, the OWNER will advise <br />the CONTRACTOR, in writing, that the OWNER has accepted the WORK. <br /> <br />III-2l <br />(1723 - 10/93) <br /> <br />
