<br />e <br /> <br />e <br /> <br />",,; <br /> <br />e <br /> <br />GC-22 <br /> <br />GC-23 <br /> <br />GC-24 <br /> <br />unforseeable weather; and <br /> <br /> <br />c. <br /> <br />To any delays of SUBCONTRACTORS occasioned by any of the causes <br />specified in paragraphs a. and b. above. <br /> <br />TIME EXTENSIONS. Changed conditions and CHANGE ORDERS, abnormal or unusual <br />weather conditions, labor strikes, and delays caused by various governmental activities may <br />be the basis for extending the period for performance. Because these various reasons for delay <br />can have cumulative effect or actually have no effect, the CONTRACTOR is required to <br />request, in writing, on a monthly basis, time extensions and to discuss these requests with the <br />ENGINEER to determine whether or not a time extension can be recommended. Should a time <br />extension be granted by the OWNER, A CHANGE ORDER, signed by the OWNER, will be <br />issued to indicate the new date for completion. <br /> <br />SATURDAY. SUNDAY, HOLIDAY, AND NIGHT WORK. Work shall normally not be <br />done on Saturdays, Sundays, observed holidays, or outside of the daytime working hours of <br />8:00 a.m. to 4:00 p.m. except for such work as may be necessary for proper care, <br />maintenance, and protection of work already done , or in cases where the work would be <br />. endangered or if hazards to life or property would result. If the CONTRACTOR believes it <br />necessary to work on Saturdays, Sundays, holidays, or at night, he shall make prior <br />arrangements with the OWNER or ENGINEER and receive written approval at least 48 hours <br />before such work period so that proper inspection and engineering service can be provided. <br />Such approval may be revoked by the ENGINEER if the CONTRACTOR fails to maintain <br />adeqnate equipment and lighting at night for the proper prosecution, control, and inspection <br />of the WORK. If WORK is done without the ENGINEER's prior approval and as a result the <br />ENGINEER had not assigned inspectors to the WORK, the WORK done during these periods <br />of time may be declared defective, solely on the grounds that it was not properly inspected. <br /> <br />PROGRESS PAYMENTS TO CONTRACTOR. At least ten (10) days before each progress <br />payment falls due (but not more often than once a month), the CONTRACTOR will submit to <br />the ENGINEER a partial payment estimate filled out and signed by the CONTRACTOR <br />covering the WORK performed during the period covered by the partial payment estimate and <br />su?ported by such data as the ENGINEER may reasonably require. If payment is requested <br />on the basis of materials and equipment not incorporated in the WORK but delivered and <br />sultably stored at or near the site, the partial payment estimate shall also be accompanied by <br />such supporting data, satisfactory to the OWNER, as will establish the OWNER's title to the <br />material and equipment and protect his interest therein, including applicable insurance. The <br />ENGINEER will, within ten (10) days after receipt of each partial payment estimate, either <br />indicate in writing his approval for payment and present the partial payment estimate to the <br />OWNER or return the partial payment estimate to the CONTRACTOR indieating in writing <br />his reasons for refusing to approve payment. In the latter case, the CONTRACTOR may make <br />the necessary corrections and resubmit the partial payment estimate. The OWNER will, within <br />thirty (30) days of presentation to him of an approved partial payment estimate, pay the <br />CONTRACTOR a progress payment on the basis of the approved partial payment estimate. <br /> <br />Owner will retain from progress payments, until payment is due under the terms and conditions <br />governing final payments, amounts as follows: <br /> <br />a. Retention of 10 percent of progress payments until the work is 50 percent satisfactorily <br />completed. <br /> <br />b <br /> <br />After the WORK is 50 percent satisfactorily completed, no further retainage shall be <br />witltheld from each subsequent progress payment unless, in the opinion of the <br />ENGINEER and the OWNER, satisfactory progress is not being made. <br /> <br />III-l9 <br />(1723 - 10/93) <br /> <br />
