E S 0 L UTI 0 N <br /> <br />WHEREAS, a floodplain information report entitled "Flood, <br />Hazard Information, Colorado River and Tributaries, Fruita, Colorado," <br />dated November, 1976, has been prepared by the United States Army <br />Corps of Engineers, Sacramento District at the request of the Town of <br />Fruita and Mesa County; and <br /> <br />WHEREAS, said report describes and outlines the floodplain <br />data and information for the storm and floodwater runoff channels or <br />basins of the study area; and <br /> <br />WHEREAS, the Board of County Commissioners of Mesa County <br />has requested the Colorado Water Conservation Board to designate and <br />approve the floodplain areas as set forth in the aforesaid report; and <br /> <br />WHEREAS, Section 37-60-106(1), Colorado Revised Statutes 1973, <br />requires the Colorado Water Conservation Board to assist in the pre- <br />vention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-201 and 30-28-111" Colorado Revised <br />Statutes 1973, provide that such legislative bodies of local juris- <br />dictions may provide zoning regulations for land uses on or along any <br />storm of floodwater runoff channel or basin only after designation and <br />approval by the Colorado Water Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes <br />1973, directs the Colorado Water Conservation Board to designate and <br />approve storm or floodwater runoff channels or basins and ,to make such <br />designations available to legislative bodies of local jurisdictions; <br />and <br /> <br />WHEREAS, the staff of the Board has reviewed said report and <br />does hereby recommend to the Colorado Water Conservation Board that the <br />Board designate and approve as floodplain areas those areas inundated <br />by a 100-year flood (intermediate regional flood) as described by the <br />floodwater surface elevations and profiles in said report; <br /> <br />NOW THEREFORE, BE IT RESOLVED by the Colorado Water Conser- <br />vation Board in regular meeting assembled in Cortez, Colorado, this <br />23rd day of September, 1977 that it does hereby designate and approve as <br />floodplain areas those areas described as being inundated by a lOO-year <br />flood as set forth in said report; and <br /> <br />, <br />.' <br />
