<br />'0.- I." ~ <br /> <br />. <br /> <br />. <br /> <br />\. ," 4. <br /> <br />RESPONSIBILITIES <br /> <br />The Federal Emergency Management Agency (FEMA) does comply, as a Federal funding <br />agency, with the National Environmental Policy Act (NEPA) PL 91-190 which was passed by <br />the Congress of the United States in 1970. Likewise, FEMA adheres to the regulations and <br />guidance issued by the Council on Environmental Quality (CEQ), which was created by that Act. <br /> <br />The following are two sections ofFEMA's regulations that pertain to the funding ofHMGP and <br />P A projects relative to the implementation ofNEP A <br /> <br />44 CFR 16.4 (a) POLICY <br />FEMA shall act with can: to assure that, in canying out its responsibilities, including disaster planning, response and <br />recovery and ba2md rilitigation and flood insurance, it does so in '3. manner consistent with national environmental <br />policies. Care shall be taken to assure, consistent with other consideIations of national policy, that all practical <br />means and measures are used to protect, restore, and ....h.nre the quality of the environmeDl, to avoid or min;nri'e <br />adverse environmental consequences. <br /> <br />.' <br /> <br />..or......_ <br /> <br />FEMA shall: <br />(1) Assess environmental consequences ofFEMA actions; <br />(2) Use a systematic, iDterdiscip1inaIy approach that will ensure the integrated use of the oatura1 and social sciences, <br />and environmental considerations. in pl.nn;ng and decision making where there is a potential for significant <br />environmenta1 impact; <br />(3) Ensure that presently unmeasured environmental amenities are considered in the decision making process; <br />(4) Consider reasonable alternatives to recommended COUIseS of action in any proposal that involves conflicts <br />concerning alternatives uses of resources; <br />(5) Make available to States, counties, municipalities, institutions. and individuals advice and information useful in <br />restoring, main1aining, and enhancing the quality of the environment. <br /> <br />'" <br /> <br />44 CFR 10.7 (c) (2) RESPONSIBILITIES OF THE APPLICANT <br />(I) Contact FEMA Region vm as early as possible in the planning process for Il"itl.nce on the scope and level of <br />environmental infonnation required to be submitted in support of their application; <br />(2) Conduct any studies wbich are deemed JICCI:SS:l'Y and appropriate by FEMA to determine the impact of the <br />proposed action on the human environmenI; <br />(3) Consult with "l'l"'Ul"'iate Federal, regional, Stale, and local agencies and other potential1y interested parties <br />during pre1iminary planning stages to ensure that all environmental factors are identified; <br />(4) Submit applications for all Federal, regional, State, and local approvals as early as possible in the planning <br />process; <br />(5) Notify FEMA Region vm as early as possible of all other Federal, regional, State, local, and Indian tribal <br />actions required for project completion so that FEMA may coordinate all Federal environmenta1 reviews; and <br />(6) Notify FEMA Region vm of all known parties potentially affected by or interested in the proposed action. <br /> <br />5 <br />
