The proposed amendment, if passed, would have specifically <br />made reference to three studies prepared by the Urban Drainage and <br />Flood Control District (UDFCD). These studies include the following: <br />Flood Hazard Delineation - Broomfield Area, Flood Hazard Delineation - <br />Direct Flow Area 0054, and Flood Hazard Delineation - Clear Creek. <br /> <br />As it reads now, Section 11.280(i) assures that the County will enforce <br />floodplain regulations contained in Chapter 11 for: "any other studies <br />which shall be designated by the Colorado Water Conservation Board." <br />Since the UDFCD studies were designated by the Colorado Water Conserva- <br />tion Board, it is our interpretation that floodplain regulations will <br />be applied to these studies. To be assured that the County intends to <br />regulate this area according to the criteria set down in Chapter 11, we <br />are asking for a response to the following question: Does the County <br />intend to enforce floodplain management regulations for the following <br />UDFCD studies: Flood Hazard Delineation - Broomfield Area, Flood Hazard <br />Delineation - Direct Flow Area 0054, and Flood Hazard Delineation - Clear <br />Creek? <br /> <br />In a related matter, we also understand that the County has never adopted <br />the Flood Insurance Rate Map (FIRM) which was issued February 1, 1979. <br />This map is a part of the Flood Insurance Study (FIS) dated August, 1978 <br />which our agency prepared and which identifies flood hazard risk zones <br />for purposes of the National Flood Insurance Program. As a condition of <br />participating in this program, the County is required to adopt the FIRM <br />and the FIS and reference them within its floodplain regulation. Therefore, <br />we are asking for a response to a second question: Does the County intend <br />to adopt the Flood Insurance Rate Map dated February 1, 1979 and Flood <br />Insurance Study dated August, 1978 and reference them in the County's <br />floodplain zoning regulations? <br /> <br />
