<br />e <br /> <br />e <br /> <br />e <br /> <br />WHEREAS, said new report includes approximate floodplain information for the following <br />reservoir area which was within unincorporated Swnmit County in November 1979, which was included <br />as approximate floodplain information in Resolution No. 167, and which is within the corporate limits <br />of the Town of Frisco as of November 4, 1994, as listed in Table 7, attached hereto and by this <br />reference incorporated herein: <br /> <br />TABLE 7 <br /> <br />Aporoximate Information Which Was Previouslv Prepared for Summit Countv <br />and Designated bv Resolution No. 167 <br />The portion of Dillon Reservoir within the corporate limits of the Town of Frisco, as they <br />were on November 4, 1994; and <br /> <br />WHEREAS, the Town of Frisco, Colorado, has requested the Colorado Water Conservation <br />Board to designate and approve the floodplains set forth in the aforesaid new report; and <br /> <br />WHEREAS, Section 37-60-106(I)(c), Colorado Revised Statutes, requires the Colorado Water <br />Conservation Board to assist in the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide that <br />legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along any <br />storm or floodwater runoff channel or basin only after designation and approval by the Colorado Water <br />Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(I)(c), Colorado Revised Statutes, directs the Colorado Water <br />Conservation Board to designate and approve storm or floodwater runoff channels or basins and to make <br />such designations available to legislative bodies of local jurisdictions; and <br /> <br />WHEREAS, the information in said new report for the stream reaches listed in Tables I, 2, 3, <br />4, 5 and 6 meets all of the requirements for detailed information listed under the Board's "Rules and <br />Regulations for the Designation and Approval of Floodplains and of Storm or Floodwater Runoff <br />Channels in Colorado" (2 CCR 408-1); and <br /> <br />WHEREAS, the information in said new report for the portion of Dillon Reservoir listed in Table <br />7 does not meet all of the requirements for approximate information listed under the Board's "Rules and <br />Regulations for the Designation and Approval of Floodplains and of Storm or Floodwater Runoff <br />Channels in Colorado" (2 CCR 408-1); <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Colorado Water Conservation Board in regular <br />meeting assembled in BreckeIlIidge, Colorado, this 4th day of November, 1994, that it does hereby <br />designate and approve as detailed floodplain infonnation the 100-year floodplains as described by the <br />floodwater surface elevations and profiles in said new report, dated November 2, 1993, for the study <br />reaches listed in Tables 1, 2, 3, 4, 5, and 6, and does hereby rescind Resolution No. 158, as listed in <br />Table I, and those portions of Resolution No. 167 listed in Tables 4,5 and 6 relating to stream reaches <br />formerly within unincorporated Summit County and within the corporate limits of the Town of Frisco <br />as of November 4, 1994; and <br /> <br />5 <br />
