<br />WHEREAS. Sections 31-23-301 and 30-28-111, Colorado Revised <br />Statutes. provide that such legislative bodies of local <br />jurisdictions may provide zoning regulations for land uses on <br />or along any storm or floodwater runoff channel or basin only <br />after designation and approval by the Colorado Water <br />Conservation Board; and <br /> <br />WHEREAS. Section 37-60-106 (1) (c). Colorado Revised <br />Statutes. directs the Colorado Water Conservation Board to <br />designate and approve storm or floodwater runoff channels or <br />basins and to make such designations available to legislative <br />bodies of local jurisdictions; and <br /> <br />WHEREAS. the staff of the Board has reviewed said revised <br />information and data and does hereby recommend to the Colorado <br />Water Conservation Board that the Board designate and approve <br />as floodplain areas those areas inundated by a 100-year flood <br />(intermediate regional flood) as described by the floodwater <br />surface elevations and profiles in said new report. and further <br />recommends that the floodplain designation for the Big Thompson <br />River, Fall River. Fish Creek. and Black Canyon Creek. as <br />approved by Resolution No. 115. adopted November 1. 1978. be <br />rescinded; <br /> <br />NOW. THEREFORE. BE IT RESOLVED by the Colorado Water <br />Conservation Board in regular meeting assembled in Denver. <br />Colorado. this 15th day of May. 1987. that it does hereby <br />designate and approve as floodplain areas those areas described <br />as being inundated by a 100-year flood as described by the <br />flQodwat.er s~~f~ce elevations and~Qfiles in said new_ repor,-h, <br />dated May 4, 1987. and does hereby rescind that said portion of <br />Resolution No. 115. dated November 1. 1987; and <br /> <br />BE IT FURTHER RESOLVED that the Secretary of the Board is <br />directed to send a certified copy of this resolution to the, <br />Town of Estes Park. the Board of County Commissioners of <br />Larimer County, the Colorado Division of Disaster Emergency <br />Services, and the Federal Emergency Management Agency. <br /> <br />Q ~ R I I E I Q ~ I ~ <br /> <br />I certify that the foregoing is a true and correct copy of <br />a resolution adopted by a majority vote of the members of the <br />Colorado Water Conservation Board in regular session assembled <br />at Denver.
