COKTRACT

THIS AGREE~lE~n J made this 19 th day of Augus t. 1987. by and be tween
the City of Alamosa, herein called "Owner," acting l-e. in through its Mayor
and a corporation doing business as Southway Construction Company, of 117
White Pine, County of Alamosa, State of Colorado, hereinafter called
"Contractor,1t

WIT~ESSETH: That for and in consideration of the payments and agree-
ments hereinafter mentioned, to be made aop performed by the OWNER. the
CONTRACTOR hereby agrees with the O~ER to commence and complete the
construction described as follows;
RIO GRANDE LEVEE IMPROVEMENTS, PHASE II
hereinafter called the project, for the su~ of two hundred seventy two
thousand eight hundred sixty five dollars" and no cents ($272,865.00) and
a: extra work in connection therewith, under the terms as stated in the
General and supplemental Conditions or the Contract; and at its own proper
cost and expense to furnish all mate~ials, su~~lies. machinery, equipment,
tools superintendence. labor, insurance and other acces~ories and services
necessary to complete the said project in accordance with the conditions and
prices stared in the Proposal. the General Ccr'itions. and Supplemental
General Conditions of the Contract, the plans ~hich include all maps, ?lats,
blue prints and other drawings and printed or written explanatory matter
thereof, the specifications and contract documents therefor as prepared by
}~LLER EKGI~EERING INC., herein entitled the Engineer, and as enumerated in
Paragraph 1 of the Supplemental General Conditions. all of which are made
a part hereof and collectively evidence and constitute the Contract.

The Contractor hereby agrees to commence work nnder this COntract on or
before a cate to be specified in a t.:ritten "Xotice to Proceed" of the Owner
and to fu::'iy complete the project within 60 consecutive calendar days
thereafter. The Contractor further ag1 es to pay. as liquidated damages,
the SliD 0:- S_~ for each consecutive c2,]endar day thereafter as
hereinafter provided in Paragraph 19 of the General Conditions.

The m7i\ER agrees to pay the CO>:TR..\CTOR in current funds for the
performance of the contract, subject to additions and deductions, as
provided in the General Conditions of the ',Jntract, and to make payments
on account thereof as provided in ParagraDh 25, "Payment to Contractor,"
of the Ge~eral Conditions.
