<br />7 <br /> <br />Payment Bond, furnish the required evidence of insurance, or <br />satisfy all conditions precedent to execution of the Contract <br />within (15) days of the date of Notice of Award, Owner may <br />annul the Notice of Award and the Bid Security of that Bidder <br />will be forfeited, not as a penalty, but as liquidated <br />damages to compensate the City for the cost of delay and also <br />as an estimate of the difference between the Bidder's Bid and <br />that of the next lowest acceptable Bid. The Bid Security of <br />any Bidder whom the City believes to have a reasonable chance <br />of receiving the award may be retained by the City (a) until <br />seven (7) days after the effective date of the Contract or <br />(b) until the Bids expire, whichever is earlier. <br /> <br />PART 8 - CONTRACT TIME <br /> <br />--- <br /> <br />8.01 The number of days within which the Work is to be <br />completed (the Contract time) is set forth in the Contract. The <br />contract time for this work is 75 days from Notice to Proceed, <br />PART 9 - LIQUIDATED DAMAGES <br /> <br />9.01 Provisions for liquidated damages are set forth in the <br />Contract and other Contract Documents. <br /> <br />PART 10 - SUBSTITUTE MATERIAL AND EQUIPMENT <br /> <br />10.01 The Contract, if awarded, will be on the basis of <br />material and equipment described in the Specifications <br />without consideration of possible substitute or "or equal" <br />items. Whenever it is indicated in the Specifications that a <br />substitute or "or equal" item of material or equipment may be <br />furnished or used by the Contractor if acceptable to the <br />Project Manager, the procedure for submittal of any such <br />application by the Contractor and consideration by the <br />Project Manager is set forth in the General Conditions. <br /> <br />PART 11 - BID FORM <br /> <br />11.01 The Contract Documents include a complete set of forms <br />which are for the convenience of Bidders and are not to be <br />detached from the Contract Documents or filled out, or <br />executed. The Bidder shall only complete the Bid Proposal <br />which is attached hereto; additional copies may be obtained <br />from the Project Manager. <br /> <br />11.02 Bid forms must be completed in ink or by typewriter. <br /> <br />11.03. Bids by corporations must be executed in the corporate <br />name by the president or a vice-president (or other corporate <br />officer accompanied by evidence of authority to sign) and the <br />corporate seal must be affixed and attested by the secretary <br />or an assistant secretary. The corporate address and state <br />of incorporation shall be shown below the signature. <br />
