<br />COLORADO DISCHARGE PERMIT SYSTEM REGULATIONS <br /> <br />61.1 GENERAL PROVISIONS <br /> <br />(1) SCOPE AND PURPOSE <br /> <br />(a) These regulations are promulgated in implementation of the Colorado Water <br />Quality Control Act as amended, and in particular sections 25-8-501 through 505, C.RS., as <br />amended and are designed to be in conformity with that act and the Federal Clean Water Act <br />and regulations promulgated thereunder. <br /> <br />(b) These regulations apply to all operations discharging to waters of the State from <br />a point source. <br /> <br />I <br /> <br />(c) Nothing in these regulations shall be construed to limit a local government's <br />authority to impose land-use or zoning requirements or other limitations on the activities subject <br />to these regulations. <br /> <br />(2) INCORPORATION BY REFERENCE <br /> <br />Throughout these regulations, standards and requirements promulgated by the U.S. <br />Environmental Protection Agency have been adopted and incorporated bY-Feference. All <br />references are from the Code of Federal Regulations dated July 1, 1996 and the Federal <br />Register Vol. 60 No. 64, Tuesday April 4, 1995 pages 17160 to 17169, unless otherwise noted. <br />This incorporation does not include later amendments or editions of the incorporated material. <br /> <br />All material incorporated by reference may be examined at any state publications depository <br />library. Requests for public inspection of materials incorporated by reference in this regulation <br />should be made to staff assistant, Permits and Enforcement Section, Water Quality Control <br />Division, at the Department of Public Health and Environment, 4300 Cherry Creek Drive South, <br />Denver, Colorado 80222-1530. <br /> <br />(3) SEVERABILITY <br /> <br />The provisions of this regulation are severable, and if any provisions or the application of the <br />provisions to any circumstances is held invalid, the application of such provision to other <br />circumstances, and the remainder of this regulation shall not be affected thereby. <br /> <br />" <br /> <br />61.2 DEFINITIONS <br /> <br />. <br /> <br />NOTE: Several terms used in this regulation that are not defined below are defined in the <br />Colorado Water Quality Control Act, 25-8-103, C.RS. <br /> <br />(1) "ACT' means the Colorado Water Quality Control Act as from time to time amended, <br />section 25-8-101 et seq, C.RS . <br /> <br />1 <br />
