NOTICE OF FINAL ADOPTION

PURSUANT to the provisions of section 24-4-103(4)(a), C.RS.

NOTICE IS HEREBY GIVEN that the Colorado Water Quality Control Commission, after a public
rulemaking process and complying with the provisions of 24-4-103 C.RS., amended on March 9,
1999, on both a permanent and emergency basis, pursuant to 25-8-202; 25-8-401; 25-8-501.1 and
25-8-504 C.RS., and Section 21.3 of the "Procedural Rules" the regulation entitled:

"Colorado Discharge Permit System Regulations" Regulation #61 (5 CCR 1002-61)

Providing for requirements to implement new section 25-8-501.1 of the Water Quality Control Act,
approved by the voters as "Amendment 14" on the November 3, 1998, ballot, pertaining to housed
commercial swine feeding operations. Amendment 14 requires that the Commission promulgate
rules by March 31,1999.

Also, pursuant to 24-4-103(8)(b), C.R.S., this amendment was submitted to the Attorney General
for review and was found to be within the authority of the Water Quality Control Commission to
promulgate, and further that there are no apparent constitutional deficiencies in its form or
substance. Furthermore, in adopting this amendment the Commission also adopted a general
Statement of Basis, Specific Statutory Authority, and Purpose in compliance with 24-4-103(4),
C.RS.

The emergency amendment is effective March 30, 1999 through April 30,..1999. This amendment
will be submitted to the Office of Legislative Legal Services within twenty (20) days after the date
oftheAttomey General's Opinion, pursuantto 24-4-103(8)(d), C.RS., and to the Secretary of State
in time for April, 1999 publication in the Colorado Register pursuant to 24-4-103(5) and (11)(d),
C.R.S., and will become effective as a permanent rule on April 30, 1999.
