Norton, Executive Director <br /> <br />WATER QUALITY CONTROL COMMISSION <br /> <br />http://www.cdpne.state.co.us <br /> <br />4300 Cherry Creek Drive South <br />Denver, Colorado 80246~1S30 <br />Phone 1303) 692.3469 <br />Fax (3031 691.7702 <br /> <br /> <br />Colorado Deparonent <br />of Public Health <br />and Environment <br /> <br />NOTICE OF FINAL ADOPTION <br /> <br />PURSUANT to the provisions of section 24-4-103(4)(a), C.RS. <br /> <br />1 <br /> <br />NOTICE IS HEREBY GIVEN that the Colorado Water Quality Control Commission, after a public <br />rulemaking process and complying with the provisions of 24-4-103 C.RS., amended on March 9, <br />1999, on both a permanent and emergency basis, pursuant to 25-8-202; 25-8-401; 25-8-501.1 and <br />25-8-504 C.RS., and Section 21.3 of the "Procedural Rules" the regulation entitled: <br /> <br />"Colorado Discharge Permit System Regulations" Regulation #61 (5 CCR 1002-61) <br /> <br />Providing for requirements to implement new section 25-8-501.1 of the Water Quality Control Act, <br />approved by the voters as "Amendment 14" on the November 3, 1998, ballot, pertaining to housed <br />commercial swine feeding operations. Amendment 14 requires that the Commission promulgate <br />rules by March 31,1999. <br /> <br />Also, pursuant to 24-4-103(8)(b), C.R.S., this amendment was submitted to the Attorney General <br />for review and was found to be within the authority of the Water Quality Control Commission to <br />promulgate, and further that there are no apparent constitutional deficiencies in its form or <br />substance. Furthermore, in adopting this amendment the Commission also adopted a general <br />Statement of Basis, Specific Statutory Authority, and Purpose in compliance with 24-4-103(4), <br />C.RS. <br /> <br />The emergency amendment is effective March 30, 1999 through April 30,..1999.
