<br />FPR 191 <br /> <br />) <br /> <br />COLORADO WATER CONSERVATION BOARD <br />823 State Centennial Building <br />1313 Sherman Street <br />Denver, Colorado 80203 <br /> <br />August 16, 1982 <br /> <br />'. <br /> <br />RES 0 L UTI 0 N <br /> <br />WHEREAS, a report entitled "Flood Insurance Study, Town of <br />Olathe, Montrose County, Colorado," which includes floodplain <br />information and, data for. the Uncompahgre River, dated March 16, <br />1982, has been prepared by MSM' Consultants, Inc., under contract, <br />with the Federal Emergency Management Agency; and <br /> <br />WHEREAS, said report describes and outlines the fioodplain <br />data and information for the storm and floodwater runoff channels <br />or basins of the study area; and <br /> <br />WHEREAS, the. Town of Olathe has requested the Colorado Water <br />Conservation Board to designate and approve the floodplain areas <br />asset forth in the aforesaid report; and <br /> <br />.. - -- -WHEREAS, - ..sec-t-ion---3-7~-60-106-H}, - coloraGo . Rev.ised. .Stat;u-tes <br />1973, requires the Colorado Water Conservation Board to assist in <br />the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised <br />Statutes 1973, provide that such legislative ,bodies of local <br />jurisdictions may provide zoning regulations for land uses on or <br />along any storm or floodwater runoff channel or basin only after <br />designation and approval by the Colorado Water Conservation <br />, Board; and <br /> <br />WHEREAS, Section 37-60-106( 1) (c), Colorado Revised Statutes <br />1973, directs the Colorado Water Conservation Board to designate <br />and approve storm or floodwater runoff channels or basins and to <br />make such designations available to legislative bodies of local <br />jurisdictions; and <br /> <br />WHEREAS, the staff of the Board has reviewed said report and <br />does hereby recommend to the Colorado Water Conservation Board <br />that the Board designate and approve as floodplain areas those <br />areas inundated by a 100-year flood (intermediate regional flood) <br />as described by the floodwater surface elevations and profiles in <br />said report; <br /> <br />. <br />
