<br />WHEREAS,' said new Flood Insurance Study describes and <br />outlines detailed floodplain information for the storm and <br />floodwater runoff channels or basins of the Fryingpan River <br />within the study area in a manner that is consistent with the <br />said report for Eagle County which was designated and approved <br />by the Colorado Water Conservation Board by Resolution No. 105; <br />and <br /> <br />WHEREAS, said new Flood Insurance Study revises, on the <br />basis of new topographic and hydraulic information developed by <br />the ColoradO Department of Highways and the Federal Emergency <br />Management Agency, the detailed floodplain information for the <br />storm and floodwater runoff channels or basins of the Roaring <br />Fork River within the portion of the study area in Pitkin <br />County, which were designated and approved by the Colorado <br />Water Conservation Board by Resolution No, 65, and the detailed <br />floodplain information for the storm and floodwater runoff <br />channels or basins of the Roaring Fork River within the portion <br />of the study area in Eagle County which were designated and <br />approved by the Colorado Water Conservation Board by Resolution <br />No. 105; and <br /> <br />WHEREAS, the Town of Basalt has requested <br />Water Conservation Board to designate and <br />floodplain ,areas as set forth in the aforesaid new <br /> <br />the Colorado <br />approve the <br />report; and <br /> <br />WHEREAS, Section <br />Statutes, requires the <br />assist in the prevention <br /><Inei <br /> <br />37-60-106(1) (c), Colorado Revised <br />Colorado Water Conservation Board to <br />of floods and flood damages therefrom; <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised <br />Statutes, provide that such legislative bodies of local <br />jurisdictions may provide zoning regulations for land uses on <br />or along any storm or floodwater runoff channel or basin only <br />after designation and approval by the Colorado Water <br />Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(1) (c), _Colorado Revised <br />Statutes, directs the Colorado Water Conservation Board to <br />designate' and approve storm --or floodwater-- rucnoIT-channels or <br />basins and to, make such designations available to legislative <br />bodies of local jurisdictions; and <br /> <br />WHEREAS, the staff of the Board has reviewed said revised <br />dea tiled informa t ion and does hereby recommend to, the Colorado <br />Water Conservation Board that the Board designate and approve <br />as floodplain areas those areas inundated by a 100-year flood <br />(intermediate regional flood) as described by the floodwater <br />surface elevations and profiles in said new report, and further <br />recommends that the floodplain designation fOl' those portions <br />of the Roaring Fork River within the corporate limits of the <br />Town of Basalt, as approved by Resolution No. 65, adopted <br />January 4, 1977, and Resolution No. lOS, adopted May 12, 1978, <br />be rescinded; <br /> <br />-2- <br />
