Construction of Projects by Non-Federal Interests <br /> <br />Authorizes local interests to undertake navigation improvements in harbors <br />after obtaining appropriate Federal and state permits. Permits the Secretary <br />to conduct studies for local interests subject to local interests furnishing <br />the funds. Authorizes the Secretary to reimburse local interests for the <br />Federal share of authorized Federal projects constructed by local interests, <br />provided the Secretary certifies, prior to cOnstruction, that this improvement <br />is economically justified and environmentally acceptable, and the Secretary <br />approves the plan for construction. The Secretary shall be responsible for <br />maintenance in accordance with Section 101(b) of this Act. <br /> <br />Section 205. Coordination and Scheduling of Federal, State, and Local Actions <br /> <br />Requires Seoretary to initiate fast-track procedures for environmental/ <br />regulatory review and coordination of all Federal, state, and local require- <br />ments when advised by non-Federal interests of their intent to construct. <br />Secretary shall advise Public Works committees of progress and schedule and <br />shall advise Congress within one year of this Act of estimated time required to <br />obtain permits and recommendations. to further reduce processing times. <br /> <br />Section 206. Nonapplicability to St. Lawrence Seaway <br /> <br />Sections 203, 204, and 205 do not apply to any harbor project on the St. <br />Lawrence Seaway. <br /> <br />Section 207. Construction in Usable Increments <br /> <br />Allows for harbor projects to be built in usable increments. <br /> <br />Section 208. Port or Harbor Dues <br /> <br />Authorizes non-Feds to levy port or harbor dues in order to finance the <br />non-Federal share of harbor construction and O&M, or for emergency response <br />services in the harbor. Establishes the jurisdiction of the U.S. District <br />Courts over the imposition, computation, collection, and enforcement of port or <br />harbor dues by a non-Federal interest. The district courts may also order <br />refunds of any fee determined to be unlawfully collected. <br /> <br />Section 209. Information for National Security <br /> <br />Requires non-F,ederal interests to provide information necessary for <br />military readiness and national security. <br /> <br />7 <br />
