<br />WHEREAS, the approximate floodplain delineation included in said new report for <br />the Roaring Fork River South Side split flow is based on the assumption that said berm has a _ <br />very strong likelihood of failing during a 100-year flood, thereby allowing floodwaters to enter ., <br />the South Side flow path on the south side of Colorado Highway 82; and <br /> <br />CONSISTENCY WITH OTHER FLOODPLAIN STUDIES <br /> <br />WHEREAS, the detailed floodplain information for the Roaring Fork River contained. in <br />said new report for the Town of Basalt and adjacent areas of unincorporated Eagle County and <br />unincorporated Pitkin County, dated July 24, 2000, revises and is, therefore, inconsistent with the <br />detailed floodplain information for Roaring Fork River contained in Resolutions Nos. 65, lOS, 169, <br />275 and 283 regarding the reach of Roaring Fork River described in Table 3; and <br /> <br />WHEREAS, the approximate floodplain information for the Roaring Fork River South Side <br />split flow contained in said new report for the Town of Basalt and adjacent areas of unincorporated <br />Eagle County and unincorporated Pitkin County, dated July 24, 2000, revises and is, therefore, <br />inconsistent with the detailed floodplain information for Roaring Fork River contained in Resolutions <br />Nos. 65, 105, 169, 275 and 283 regarding the reach of Roaring Fork River South Side split flow <br />described in Table 4; and <br /> <br />LOCAL REOUEST FOR DESIGNATION ACTION <br /> <br />WHEREAS, the Town of Basalt, Colorado, has requested the Colorado Water Conservation <br />Board to designate and approve the floodplains set forth in the aforesaid new report; and <br /> <br />e <br /> <br />eR.S, AUTHORITY <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the Colorado <br />Water Conservation Board to assist in the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide that <br />legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along any <br />storm or floodwater runoff channel or basin only after designation and approval by the Colorado Water <br />Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, directs the Colorado <br />Water Conservation Board to designate and approve storm or floodwater runoff channels or basins and <br />to make such designations available to legislative bodies oflocal jurisdictions; and <br /> <br />e <br /> <br />4 <br />
