NON STRUCTURAL FLOODPLAIN MANAGEMENT <br /> <br />A. Authority <br /> <br />The authority of the state to regulate land use is <br />derived from its police power. Police power is an inherent <br />attribute of sovereignty with which a government is endowed <br />for the protection and general welfare of its ci tizeIls. <br />Cottrell Clothing ~ ~ Teets, 139 Colo. 558. 342 P.2d 1016 <br />(1959) . The State leg~slature has delegated much of the <br />responsibili ty for the regulation of land use to local <br />governments. Local governments are expressly authorized to <br />enact zoning resolutions for the purpose of flood protection. <br />section 31-23-301, et seq. and Section 30-28-111. et seq., <br />C.R.S. 1973. Even if there were no such specific authori- <br />zation, floodplain zoning can be justified under a general <br />grant of authority to zone for the purposes of protecting the <br />heal tho safety. and welfare of the community. Note that local governments do not have the author- <br />i ty to apply floodplain zoning ordinances retroactively. <br />section 30-28-120, C.R.S. 1973. as amended; <br />Section 31-23-301, C.R.S. 1973. <br /> <br />B. Constitutional Challenges to Floodplain Zoning. <br /> <br />1. Presumption of Constitutionality and Burden <br />of Proof. <br /> <br />A zoning ordinance is presumed to be consti tu- <br />tional. The party challenging the ordinance has the burden <br />of proving its unconstitutionality beyond a reasonable doubt. <br />Board of County commissioners ~ Mountain Air Ranch. 192 <br />Colo. 364, 563 P.2d 341 (1977); Baum v. Denver, 147 Colo. <br />104, 363 P. 2d 688 (1961). Where the reasonableness of a <br />zoning ordinance is fairly debatable it must be upheld. <br />Nopro ~ ~ Town of Cherry Hills Villaqe, 180 Colo. 217, 504 <br />P.2d 344 (1973). <br />
