<br />. <br /> <br />. <br /> <br />I""'" I' . <br />t:J/;8t <br /> <br />MEMORANDUM OF AGREEMENT <br />CONTRACT #: 80EM75370 <br />Between the <br />Department of Local Affairs - Division of Local Government <br />Office of Emergency Management <br />And the <br />Department of Natural Resources <br />Colorado Water Conservation Board <br />(performance Period - September 30, 1997, through September 30, 1998) <br /> <br />This MOA, is made by and between the Department of Local Affairs, Division of Local Government, <br />Office of Emergency Management (OEM) 1313 Sherman Street, Room 521, Denver, Colorado, and <br />the Department of Natural Resources, Colorado Water Conservation Board (CWCS) 1313 Sherman <br />Street, Room 721, hereinafter referred to as CWCB. <br /> <br />WHEREAS, the purpose of this MOA is to further the goals of flood hazard reduction by improving <br />administration of floodplain management programs and fostering the goals and objectives of the <br />National Flood Insurance Program (NFIP) related activities and flood control and floodplain <br />management activities within Colorado; and <br /> <br />WHEREAS, the authority of the CWCS to use grant funds for this project is derived through <br />Agreement Nwnber EMD-97 -P A-0225, the Community Assistance Program-State Support Services <br />Element (CAP-SSSE) which is part of the FY 97 CA between the Office of Emergency Management <br />and the Federal Emergency Management Agency (FEMA). The CWCS was designated by Governor <br />Lamm on October 1, 1977 to coordinate and administer the NFIP and derives statutory authority <br />through Section 37-60-106 (1) (3) of the Colorado Revised Statutes; and <br /> <br />WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated and otherwise <br />made available and a sufficient unencwnbered balance remains available for payment in Fund Nwnber <br />100, Appropriation Code Nwnbers 753, 763, 768 and 769, Org. Unit SE.s'O, GSL F753, F763, F768 <br />and F769, RCAT 3753, 3763, 3768, 3769, Contract Encumbrance 80EM75370; and <br /> <br />NOW THEREFORE it is hereby agreed that: <br />1. Scope of Work <br /> <br />The CWCS shall be responsible for the applicable provisions of the FEMA and <br />Colorado OEM FFY 97 Comprehensive Agreement (CA) including performance <br />reporting on a annual basis and budget reporting on a quarterly basis. The FEMA <br />funded Flood Mitigation Assistance (FMA) program was enacted as part of the 1994 <br />National Flood Insurance Program (NFIP) Reform Act The FMA program is a state- <br />administered program through which States and local governments receive cost-shared <br />grants for pre-disaster flood mitigation activities. $130,000 has been made available <br />through the FY97 CA for eligible planning and project activities in Colorado. The <br />swn ofSll,900 has been made available through the FY97 CA for planning activities <br />by local governments, specifically development of comprehensive local flood hazard <br />mitigation plans.
