No. 139 <br /> <br />) <br /> <br />COLORADO WATER CONSERVATION BOARD <br />823 state Centennial Building <br />1313 Sherman street <br />Denver, Colorado 80203 <br /> <br />May 18, 1979 <br />R E ~ 0 L UTI 0 N <br /> <br />WHEREAS, a report entitled "Flood Insurance Study, city <br />of Fort Collins, Colorado," which includes floodplain information <br />and data for Dry Creek, Spring Creek and Spring Creek. Overflow, <br />dated January, 1979, has been prepared by Gingery Associates, Inc., <br />under contract with the Federal Insurance Administration: and . <br /> <br />WHE~AS, said report describes and outlines the floodplain <br />data and information for the storm and floodwater runoff channels <br />or basins of the study area; and <br /> <br />WHEREAS, the City of Fort Collins has requested the <br />Colorado Water Conservation Board to designate and approve the <br />floodplain areas as set forth in the aforesaid report; and <br /> <br />WHEREAS, Section 37-60-106(1), Colorado Revised Statutes <br />1973, requires the Colorado Water Conservation Board to assist in <br />the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-201 and 30-28-111, Colorado <br />Revised Statutes 1973, provide that such legislative bodies of <br />) lOcal jurisdictions may provide zoning regulations for land uses <br />on or along any storm or floodwater runoff channel or basin only <br />after designation and approval by the Colorado Water Conservation <br />Board; and <br /> <br />WHEREAS, Section 37-60-106(1) (c), Colorado Revised <br />Statutes 1973, directs the Colorado Water Conservation Board to <br />designate and approve storm or floodwater runoff channels or basins <br />and to make such designations available to legislative bodies of <br />local jurisdictions: and <br /> <br />WHEREAS, the staff of the Board has reviewed said report <br />and does hereby recommend to the Colorado Water COnservation Board <br />that the Board designate and approve as floodplain areas those areas <br />inundated by a 100-year flood (intermediate regional flood) as <br />described by the floodwater surface elevations and prOfiles in said <br />report: <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Colorado Water <br />Conservation Board in regular meeting assembled in Grand Junction, <br />Colorado, this 18th day of May, 1979, that it does hereby designate <br />and approve as floodplain areas those areas described as being <br />inundated by a 100-year flood as described by the floodwater surface <br />elevations and profiles in said report; and <br />
