IN THE GRANADA, COLORADO, flOOD CONTROL PROJECT

and between the UNITED STATE:S OF AMERICA, hereinafter called the "Government",

represented by the Contracting Officer executing this Agreement. and the Town

of Granada, Colorado, a municipal corporation of the State of Colorado, here.

inafter called the "Town";

WITNESSETH THAT:

WHEREAS, the Town desires to cooperate with the Government to the extent

necessary for the construction of flood control works at the Town of Granada,

Colorado, in and adjacent to Wolf Creek. such ~rk to be performed and accom-

plished by the United States; and

WHEREAS, construction of such flood control works is authorized by

Section ZOS of the Flood Control Act of 1948, .s amended; and

WHEREAS, Section ZZI of the Flood Control Act of 1970, Public Law 91-611,

requires a written agreerrent for projects inVOlving construction that conmences

on or after Janua~ I, 1972i and

WHEREAS, Section Z07 of the Unifonn Relocation Assistance and Real Property

Acqui,ition Policies Act of 1970, Public Law 91-646, hereinafter referred to as

the "Relocation Assistance Act". l~equires that the local sponsor, in furniShing

real property incident to Fede,'al assistance, "ake an payments and provide all

assistance and assurance provided by Sections 210 and 305 of the Act; and

WHEREAS, the Town hereby ,'ep.'esents that "it has the authority and capa-

bility to furnish tlte non-Fede,'al cooperation ,'equired by the Federal

legislation authorizing the I'rojec:t and by oth!!r applicable law,

NOW, THEREFORE, the parti!!s ^9ree as follows:

1. The Town agrees that if the Govemment shall conltlence construction

of the flood control works at Granada, Colorado, substantially in accordance
