<br />WHEREAS, Gingery Associates Inc.under contract to the Urban Drainage and Flood <br />Control District prepared a detailed floodplain information study entitled "Flood Hazard Area <br />Delineation, Clear Creek, Adams County and Jefferson County" dated November 1979; and <br /> <br />WHEREAS, said report includes detailed floodplain information for Clear Creek within the <br />corporate limits of the City of Wheat Ridge as they were in November 1979; and <br /> <br />WHEREAS, the Colorado Water Conservation Board, as requested by the Urban Drainage <br />and Flood Control District, designated and approved said report by Resolution No. 155 on January <br />30,1980;and <br /> <br />WHEREAS, Boyle Engineering Corporation under contract to the Urban Drainage and <br />Flood Control District prepared a detailed floodplain information study entitled "Flood Hazard <br />Area Delineation, Upper Lena Gulch" dated JanllilIY 1983; and <br /> <br />WHEREAS, said report includes detailed floodplain information for Lena Gulch within the <br />corporate limits of the City of Wheat Ridge as they were in January 1983; and <br /> <br />WHEREAS, the Colorado Water Conservation Board, as requested by the Urban Drainage <br />and Flood Control District, designated and approved said report by Resolution No. 347 on <br />September 10, 1993; and <br /> <br />WHEREAS, the Federal Emergency Mwagement Agency prepared a detailed floodplain <br />information map entitled "Flood Insurance Rate Map, City of Wheat Ridge, Colorado", dated <br />January 3,1983; and <br /> <br />WHEREAS, the Federal Emergency Management Agency prepared a detailed <br />floodplain information map entitled "Flood Insurance. Rate Map, City of Wheat Ridge, <br />Colorado", dated February 4, 1988; and <br /> <br />WHEREAS, the Colorado Water ConserVation Board has never designated and approved <br />the detailed floodplain information contained in the Flood Insurance Rate Maps for the City of <br />Wheat Ridge dated Janaury 3, 1983 and February 4, 1988, respectively; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the Colorado <br />Water Conservation Board to assist in the prevention of floods and flood damages therefrom; <br />and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide <br />that legislative bodies of local jurisdictions may provide zoning regulations for land uses on or <br />along any storm or floodwater runoff channel or basin only after designation and approval by <br />the Colorado Water Conservation Board; and <br /> <br />2 <br />
