WHEREAS, Gingery Associates Inc.under contract to the Urban Drainage and Flood
Control District prepared a detailed floodplain information study entitled "Flood Hazard Area
Delineation, Clear Creek, Adams County and Jefferson County" dated November 1979; and

WHEREAS, said report includes detailed floodplain information for Clear Creek within the
corporate limits of the City of Wheat Ridge as they were in November 1979; and

WHEREAS, the Colorado Water Conservation Board, as requested by the Urban Drainage
and Flood Control District, designated and approved said report by Resolution No. 155 on January
30,1980;and

WHEREAS, Boyle Engineering Corporation under contract to the Urban Drainage and
Flood Control District prepared a detailed floodplain information study entitled "Flood Hazard
Area Delineation, Upper Lena Gulch" dated JanllilIY 1983; and

WHEREAS, said report includes detailed floodplain information for Lena Gulch within the
corporate limits of the City of Wheat Ridge as they were in January 1983; and

WHEREAS, the Colorado Water Conservation Board, as requested by the Urban Drainage
and Flood Control District, designated and approved said report by Resolution No. 347 on
September 10, 1993; and

WHEREAS, the Federal Emergency Mwagement Agency prepared a detailed floodplain
information map entitled "Flood Insurance Rate Map, City of Wheat Ridge, Colorado", dated
January 3,1983; and

WHEREAS, the Federal Emergency Management Agency prepared a detailed
floodplain information map entitled "Flood Insurance. Rate Map, City of Wheat Ridge,
Colorado", dated February 4, 1988; and

WHEREAS, the Colorado Water ConserVation Board has never designated and approved
the detailed floodplain information contained in the Flood Insurance Rate Maps for the City of
Wheat Ridge dated Janaury 3, 1983 and February 4, 1988, respectively; and

WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the Colorado
Water Conservation Board to assist in the prevention of floods and flood damages therefrom;
and

WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide
that legislative bodies of local jurisdictions may provide zoning regulations for land uses on or
along any storm or floodwater runoff channel or basin only after designation and approval by
the Colorado Water Conservation Board; and
