These sections require: <br /> <br />a. A payment bond on the part of the contractor for payment of all <br />amounts 1 awfully due when the contract pri ce is for more than $50,000. A <br />"payment bond" 1S one executed in connection with a contractor to assure <br />payment as required by law of all persons supplying labor and material in the <br />execution of the work provided for in the contract. (Section 38-26-105), <br /> <br />b. A performance bond on the part of the contractor for <br />the full amount of the contract when <br />the contract price 1 s for more than $50,000. A "performance bond" is one <br />executed in connection with a contract to secure fulfillment of all the <br />contractor's obligations under such contract. (Section 38-26-106). The bonds <br />shall be obtained from companies holding certificates of authority as <br />acceptable sureties. A certified or cashier's check or a bank money order may <br />be accepted in lieu of a bond. <br /> <br />Exhibit VIII-J. provides a sample form of both payment and performance <br />bonds. <br /> <br />16. WAGES AND SALARIES <br /> <br />a. Attention of Bidders is particularly called to the requirements con- <br />cerning the payment of not less than the prevailing wage and salary rates <br />specified in the Contract Documents and the conditions of employment with res- <br />pect to certain categories and classifications of employees. <br /> <br />b. The rates of pay set forth under GENERAL CONDITIONS are the minimums <br />to be paid during the life of the Contract. It is therefore the responsibility <br />of Bidders to inform themselves as to Davis-Bacon requirements as well as to <br />the local labor conditions such as the length of work day and work week, over- <br />time compensati on, health and welfare contri buti ons, J abor supply and, prospec- <br />tive changes or adjustments of rates. <br /> <br />c, lJavi5-Bacoll prevailing \-Iuge rates are applicable to a portion of the <br />contract as outlined in the bid form, Other portions of the work are excluded <br />from those provisions as shown on the Drawings and in the Bid Form. <br /> <br />17. EQUAL EMPLOYMENT OPPORTUNITY <br /> <br />Attention of Bidders is particularly called to the requirement for ensur- <br />ing that employees and applicants for employment are not discriminated against <br />because of their race, color, religion, sex, or national origin. The <br />contractor will be required to take affirmative action to ensure that <br />employees and applicants for employment are not discriminated against. <br /> <br />18. "SECTION 3" COMPLIANCE IN THE PROVISION OF TRAINING, EMPLOYMENT AND <br />BUSINESS OPPORTUNITIES <br /> <br />Attention of bidders is particularly called to the so-called Section 3 <br />provisions which require that, to the greatest extent feasible, opportunities <br />for training and employment be given to lower-income residents of the project <br />area and contracts for work in connection with the project be awarded to <br />business concerns which are located in or owned in substantial part by persons <br />residing in the project area. <br /> <br />VI II-C-5 <br />
