<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />'-' <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />. <br /> <br />59. <br /> <br />60. <br /> <br />61. <br /> <br />62. <br /> <br />63. <br /> <br />~ <br /> <br />4., <br /> <br />~ <br /> <br />----- <br />. <br /> <br />Fringe Benefits Not Expressed as Hourly Wage Rates <br /> <br />The Local Public Agency shall require, whenever the minimum wage rate <br />prescribed in the Contract for a class of laborers or mechanics <br />i ncl udes a fri nge benefi t which is not expressed as an hourly wage <br />rate and the Contractor is obligated to pay cash equivalent of such a <br />fringe benefit, an hourly cash equivalent thereof to be established. <br />In the event the interested parties cannot agree upon a cash equiva- <br />1 ent of the fri nge benefi t, the questi on, accompani ed by the recom- <br />mendation of the Local Public Agency, shall be referred to the <br />Secretary of Labor for determination. <br /> <br />Posting Wage Determination Decisions and Authorized Wage Deductions <br /> <br />The applicable wage poster of the Secretary of Labor, United States <br />Department of Labor, and the applicable wage determination decisions <br />of said Secretary of Labor with respect to the various classifica- <br />tions of laborers and mechanics employed and to be employed upon the <br />work covered by thi s Contract, and a statement showi ng all deduc- <br />tions, if any, in accordance with the provisions of this Contract, to <br />be made from wages actually earned by persons so employed or to be <br />employed under such classifications, shall be posted at appropriate <br />conspicuous points at the site of the work. <br /> <br />Complaints, Proceedings, or Testimony by Employees <br /> <br />No laborer or mechanic to whom the wage, salary, or other labor <br />standards provisions of this Contract are applicable shall be dis- <br />charged or in any other manner discriminated against by the <br />Contractor or any subcontractor because such employee has fi 1 ed any <br />complaint or instituted or caused to be instituted any proceeding or <br />has testifi ed or is about to testify in any proceedi ng under or <br />relating to the labor standards applicable under this Contract to his <br />employer. <br /> <br />Claims and Disputes Pertai~ing to Wage Rates <br /> <br />Claims and disputes pertaining to wage rates or to classifications of <br />laborers and mechanics employed upon the work covered by this <br />Contract shall be promptly reported by the Contractor in writing to <br />the Local Publ ic Agency or Publ ic Body for referral to the Secretary <br />of Labor, United States Department of Labor, whose decision shall be <br />final with respect thereto. <br /> <br />Questions Concerning Certain Federal Statutes and Regulations <br /> <br />All questions arising under this Contract which relate to the <br />application or interpretation of tal the aforesaid Anti-Kickback Act, <br />{bl the Contract Work Hours and Safety Standards Act, (cl the afore- <br />sai d Davi s-Bacon Act, {d l the regul ati ons issued by the Secretary of <br />Labor, United States Department of Labor, pursuant to said Acts, or <br />tel the labor standards provisions of any other pertinent Federal <br />statute, shall be referred through the Local Public Agency and to the <br /> <br />VII I-H-23 <br />
