I I I I I I I I I I I I I I I I I 43. 44. 45. 46. 47. - Provisions Required by Law Deemed Inserted Each and every provision of law and clause required by law to be inserted in thi s Contract shall be deemed to be inserted herei nand the Contract shall be read and enforced as though it were i ncl uded herein, and if through mistake or otherwise any provision is not inserted, or is not correctly inserted, then upon the application of either party the Contract shall forthwith be physically amended to make such insertion or correction. Protection of Lives and Health "The Contractor shall exercise proper precaution at all times for the protection of persons and property and shall be responsibie for all damages to persons or property, either on or off the site, which occur as a result of his prosecution of the work. The safety provi- sions of applicable laws and building and construction codes, in addition to specific safety and health regulations described by Chapter XIII, Bureau of Labor Standards, Department of Labor, Part 1518, Safety and Health Regulations for Construction, as outlined in the Federal Register, Volume No. 75, Saturday, April 17, 1971. Title 29 - LABOR, shall be observed and the Contractor shall take or cause to be taken, such additional safety and health measures as the Contracting Authority l!Iay determine to be reasonably necessary." Subcontracts "The Contractor will insert in any subcontract the Federal Labor Standards Provisions contained herein and such other clauses as the Department of Housing and Urban Development or Colorado Department of Local Affairs may, by instructions require, and also a clause requir- i ng the subcontractors to i ncl ude these clauses in any lower ti er subcontracts which they may enter into, together with a clause requiring this insertion in any further subcontracts that may in turn be made." Interest of Members of or Delegate to Congress No members of or Delegate to Congress shall be admitted to any share or part of this Contract or to any benefit that may arise therefrom, but this provision shall not be construed to extend to this Contract if made with a corporation for its general benefit. Other Prohibited Interests No official of the Owner who is authorized in such capacity and on behalf of the Owner to negotiate, make, accept or approve, or to take part in negotiating, making, accepting, or approving any architec- tural, engineering, inspection, construction or material supply con- tract or any subcontract in connection with the construction of the project, shall become directly or indirectly interested personally in this Contract or in any part hereof. No officer, employee, archi- tect, attorney, engineer or inspector of or for the Owner who is authorized in such capacity and on behalf of the Owner to exercise any legislative, executive, supervisory or other similar functions YIl I -H-17
