;PJT BY': USAC~;
" '.

40~ 2~1 7164;

AUG.4 <)3 17: 59 j

-2-

Response No.3 - The Corps participation with the eWeB and Working Group
has provid"d new insights inlu the unique geography and weather pauems of the Cherry
Creek Basin. This insight ean provide an opportunity for adjustments to be made to the
Corps regulations specific only to the Cherry Creek Basin, based on that uniqueness.
Adjustments may need to be made to the values being used by all parties, if we are to get
an appropriate resolution.

Request No.4 - Should the Corps not have the resources to address Requests 1
through 3; can the Corps partner with the CWCB and National Weather Service in ajuint
request to the National Academy of Sciences for the resolution and detennination of
reasonable PMP values for the Cherry Creek Ba.,in using the findings in the NWS 1995
PMP Study and the A W A 2003 PMP Study?

Response No.4 - The Corps considers the Cherry Creek PMP issue to be very
important. As such, the probability of the Corp not finding resources to fulfill our
commitment to responses 1 through J is unlikely. But iffor some reason the Corps
cannot perform these items, the Corps would be mare than willing to partner with the
eWCB and National Weather Service in ajointl'equest for National Academy of Science
assistance in resolving the PMP differences.

We have based these responses on our conlidence that the CWCB and Working
Grollp will work with the Colorado Congressional members in gelling FY04 legislation
allowing the Corps to fulfill all of thcsc responses. The Corps has carefuUy adhered to
the federallegislalion on Cherry Creek authored by the Colorado Congressional
delegation and will proceed with these requests only after receiving confirmation that thc
Colorado Congressional members, specifically Representatives Helley and Tancredo,
cOllcur with U,C Corps' actions. A copy of this lelter has been scnt to Congressman
Hefley and Congressman Tancredo.

Great progress has been made on the PMP issue in the last few years and 1 s<c
llltil prugress continuing. [fyou have any questions, please contact me or Mr. WiIliam
Miller, Project Manager at (402) 221-4022.

Sincerely,

~b~

Colonel, Corps of Engineers
Di strict Engineer

Endu,UI~

PAG~ ~/4.
