<br />WHEREAS. Section 37~60-106(1). colorado Revised Statutes
<br />1973, requires the Colorado Water Conservation Board to assist in
<br />the prevention of floods and flood, damages-therefrom; and
<br />
<br />WHEREAS, Sections 31-:-23-201 and 30-28'-111, colorado Revised
<br />Statutes ,1973, provide- that, such legislative bodies of local juris-
<br />dictions may provide 'zoning regulations ,for land uses on,or along
<br />, any storm or floodwater runoff channel or basin only after desig-
<br />nation,and approval by the Colorado Water conservation Board; and
<br />

<br />WHEREAS:,the Board of Commissioners 'of Eag,le county have
<br />stated- that'thE'Y' will regulate the storm, and floodw-aterJ;"unoff
<br />channe'ls (Zone A), on acase-by-case, basissubje,ct' to" a detailed'
<br />hydrologic and hydraulic analysis by a professional engineer i and

<br />WHEREAS, section 37-60-106(1) (c) ,Colorado Revised ,Statutes
<br />1973, directs the Colorado Water con set vat ion Board -to- designate'
<br />and approve storm or floodwater runoff ,channels,or basins and ,to
<br />make such,designationsavailable,to, legislativebodiesof'local

<br />WHEREAS, the staff of the-l3oardhas reviewed the,Plood
<br />,'Insurance, Study' and does hereby , recommend to'" the Co lOr ado Water '
<br />Conservation Board that the Board designate and approve as, flood-
<br />plain" areas ,those areas inundated l:lY 'a lOO-year, flood as described
<br />by the: 'floodwater sur face elevations and, prOfiles, in said ,report
<br />for, Buffehr:Creek, Eagle River_at Minturn, ,Taylor' Creek,'Brush'
<br />Creek, Eagle River at Red Cliff,<indTurkey Creek--the R6a:ring Fork
<br />River and ,the' Fryingpan', Riverha ving been previous lydesi-gnated
<br />'by 'Resolution Number ,105--and qesignate and approve as ' storm or
<br />, floodwate'rrunoff 'channels' or basins ,those areas as delineated by
