<br />areas, and overflows from irrigation ditches and canals has not been established by the <br />Guidelines for Determining IOO-year Flows for Approximate Floodplains; and those <br />floodplain areas may not be designated as approximate floodplain information without a <br />procedure for estimating 100-year peak flows, and the local government understands and agrees <br />that a detailed hydrologic and hydraulic study should be performed by a professional engineer <br />and submitted by the developer or the development proponent prior to any floodplain <br />development in those cases; and <br /> <br />WHEREAS, Fremont County, Colorado has requested the Colorado Water <br />Conservation Board to designate and approve the floodplain information set forth in Table I, <br />Table 2, and Table 3; and <br /> <br />WHEREAS, Fremont County, Colorado, has not requested the Colorado Water <br />Conservation to rescind any of the detailed floodplain information contained in Resolution Nos. <br />185 and 189; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the Colorado <br />Water Conservation Board to assist in the prevention of floods and flood damages therefrom; <br />and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide <br />that legislative bodies of local jurisdictions may provide zoning regulations for land uses on or <br />along any storm or floodwater runoff channel or basin only after designation and approval by <br />the Colorado Water Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(l)(c), Colorado Revised Statutes, directs the Colorado <br />Water Conservation Board to designate and approve storm or floodwater runoff channels or <br />basins and to make such designations available to legislative bodies of local jurisdictions; and <br /> <br />WHEREAS, the information in said new report for said stream reaches in Fremont <br />County, which have drainage areas that fall within the applicable range of the Guidelines or any <br />applicable USGS hydrology publication meets all of the requirements for approximate <br />information listed under the Board's "Rules and Regulations for the Designation and Approval <br />of Floodplains and of Storm or Floodwater Runoff Channels in Colorado" (2 CCR 408-1); and <br /> <br />WHEREAS, Colorado Water Conservation Board has determined that the hydrologic <br />methodology developed in the Guidelines for Determining IOO-Year Flood Flows for <br />Approximate Floodplains is appropriate for designation and approval of approximate <br />floodplain information and for use in simple floodplain analyses for development such as open <br />space, agricUlture,- fann bridges, pole bams and individual single residential structures, but that <br />the methodology is not appropriate for development involving residential subdivisions greater <br />than 50 lots or occurring on sites greater than 5 acres, commercial construction, industrial <br />construction, construction of public transportation facilities or construction of flood control <br />activities; <br /> <br />7 <br />
