WITNESSETH:

from the ARKNISAS RIVER AND TRIBUTARIES ilt and ln the viCinity of Las Animas,
Colorado, which flood protection ,'orks herelnafter sometimes calle.j the
"Project," are being underta~en by the United States as set forth In Section
204, Title II, of the Flood Control Act of 1965, Public Law 89-291>, i1pproved

October 27, 1965; and

WHEREAS, Section 221 of the Flood Control Act of 1970, Public Law

91-611, requires a written agreement for projects involving constr'lIctlon

that commences on or after January 1. 1972; and

WHEREAS, Section 204 of Pub1k lilw 89-29B calls for assurance' that

the District will:

a. Provlde without cost to the United States all lands, easements,

and rights-of-Nay necessary for construction of the Project. including

easements required for flood-zonin!) purposes in the ponding area;

b. Hold and save the United St<lte~> free from daraages due to the con-

struction w~rk;

c. At least annually 1nfonn 1ndiv'lduals concerned about the residual

flood problem lnvolved 0,,1ng to tempora.)' ponding;
