<br />. <br /> <br />. <br /> <br />. <br /> <br />Section 404 Permitting and Floodplain Management <br /> <br />Tim Carey, Operations Project Manager <br />Corps of Engineers, Omaha District <br />Tri-Lakes Project Office <br />Littleton, Colorado <br /> <br />Abstract <br /> <br />The Corps of Engineers (Corps) is responsible for administering Section 404 of the Clean <br />Water Act, commonly referred to as the Corps' Regulatory Program. Section 404 regulates <br />the placement of dredged or fill material into waters of the United States, including special <br />aquatic sites (most commonly wetlands). Authorization from the Corps for your project may <br />take the form of an Individual Permit, Regional General Permit, or Nationwide Permit. <br />Recent changes to the Corps' Regulatory Program include the issuance of new Nationwide <br />Permits on December 13, 1996, and the June 25, 1997, decision by the U.S. Circuit Court <br />for the District of Columbia. With this decision, the Circuit Court granted a stay of the <br />District Courts' decision on the American Mining Congress vs. Corps of Engineers lawsuit, <br />thereby placing back into effect the Tulloch Rule (also known as the "Excavation Rule"). <br />
