OF PUBLIC HEALTH & ENVIRONMENT <br />Water Quality Control Division <br />4300 Cherry Creek Dr. S. <br />Denver, CO 80246-1530 <br /> <br />. <br /> <br />ABSTRACT <br /> <br />Kathy Dolan <br />9/22/97 <br /> <br />THE STORMWATER PROGRAL"I: <br />PHASE II <br /> <br />We've come a long ways from October I, 1992, when the Colorado stormwater program first <br />began. There are now six stormwater general permits in place, and over 2500 permittees under <br />them. Four municipal separate stormwater system (MS4) permits have been issued. These include <br />PC;";1liLS for Denv~r, Aurora, Lakewood, and Colorado Springs. Arapahoe County is well on the <br />way with their application, and CDOT is patiently waiting for their permit. <br /> <br />So, what comes next? Can we relax a bit and look to just maintaining the program we've built so <br />painstakingly? Definitely not. We've been working under Phase 1. Phase II is now on the <br />horizon, and wiII bring us a whole new realm of challenges to consider. <br /> <br />First, the status of the regulations themselves. EP A is under a court order to have the draft <br />regulations published in the Federal Register by the end of November, 1997. The same court <br />order says that the final regulations must be in place by March, 1999. EPA plans to do everything <br />possible to meet these deadlines. <br /> <br />. <br /> <br />What exactly wiII the new regulations contain? The draft has several interesting new provisions. <br />For example, the list of covered industries is not expected to be increased. Also, the regulations <br />currently allow so-called "light industry" to opt out of permit coverage if they do not have any <br />industrial materials or activities exposed to stormwater. This has been broadened to include all of <br />the industrial categories. <br /> <br />Secondly, the industrial permitting exemption for small municipalities (under 100,000 population) <br />will expire on August 7, 2001. This means that industrial activities owned or operated 'by small <br />municipalities (such as construction operations and gravel pits) will need permit coverage. <br /> <br />In addition, small municipalities in urbanized areas have been brought into the municipal part of <br />the program, but with simpler application and permit requirements than for the larger <br />municipalities, Small municipalities that are outside of urbanized areas may also be designated as <br />needing permit coverage, if they meet certain criteria. <br /> <br />Third, the minimum size of construction projects needing permits has been reduced from five acres <br />of disturbed area, to just one acre. This will substantially increase the number of construction <br />permits in the system. However, there are some provisions for a waiver for small (under five <br />acres) construction sites, if certain criteria are met. <br /> <br />. <br /> <br />The Division will be providing education and interpretation of the new regulations, although the <br />format has yet to be determined. Public comment will also be sought by EPA, once the draft <br />regulations have been published.
