<br />WHEREAS, the <Ietailed information contained in said new report, which is based on the <br />hydrology values provided in the Sterling Flood Insurance Study (Resolution No. 400), provides <br />lDO-year flood profiles and floodplain delineations from Iris Drive to County Road 29 for the <br />Pawnee Creek overflows within the City of Sterling and Logan County, which is an area that has <br />not previously been studied; and <br /> <br />LOCAL REQUEST FOR DESIGNATION <br /> <br />WHEREAS, the City of Sterling has requested the Colorado Water Conservation Board to <br />designate and approve the detailed floodplain information as set forth in said new report dated February <br />3,1997; and <br /> <br />WHEREAS, the City of Sterling has not requested the Colorado Water Conservation Board to <br />rescind any of the previously completed floodplain information as listed in Table I; and <br /> <br />C.R.S. AUTHORITY <br /> <br />WHEREAS, Section 37-60-106(l)(c), Colorado Revised Statutes, requires the Colorado Water <br />Conservation Board to assist in the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide that <br />legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along any <br />storm or floodwater runoff channel or basin only after designation and approval by the Colorado Water <br />Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(l)(c), Colorado Revised Statutes, directs the Colorado Water <br />Conservation Board to designate and approve storm or floodwater runoff channels or basins and to <br />make such designations available to legislative bodies of local jurisdictions; and <br /> <br />COMPLIANCE WITH CWCB TECHNICAL STANDARDS <br /> <br />WHEREAS, the floodplain information itl said new report dated February 3, 1997 meets all of <br />the requirements, based on a cursory review by the CWCB staff and a more detailed review by the City <br />of Sterling staff, for detailed information listed under the Board's "Rules and Regulations for the <br />Designation and Approval of Floodplains and of Storm or Floodwater Runoff Channels in Colorado" <br />(2 CCR 408-1); <br /> <br />DESIGNATION AND APPROVAL ACTION <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Colorado Water Conservation Board in <br />regular meeting assembled in Pueblo, Colorado, this 12th day of May, 1997, that it does hereby <br />designate and approve as detailed floodplain information the I DO-year floodplain data as described in <br />said new report dated February 3, 1997; and <br /> <br />'J. <br />
