" <br /> <br />In 1966 the General Assembly also amended article 1, chapter <br />149, Colorado Revised Statutes 1963, (re.-coded as article 60 or title <br />37, C .R.S. 1973)., relating to the. Colorado water Conservation Board, <br />to provide as follows: <br /> <br />"37-60-106. Duties of the .boarcL. .- (4) TO devise and formulate <br />methods, means, and plans for bringing about t;he greater utilization <br />of t:he waters of the state and the px'eve,nt.ion of flood damages there- <br />from, and to designate and approve st;orm or floodwateJ: runoff channels <br />or basins, and to make such designations available to legislative <br />bodies of cities and incorporated to~ms, to county planning commis- <br />sions, and to boards of adjustment of cities, incorpOJ:ated towns, and <br />counties of this state." <br /> <br />In 1974 the General Assembly added a new article 7 to chapter <br />106, Colorado Revised Statutes 1963, (re-coded as article 65.1 of <br />title 24, C.R.S. 1973 0975 Supp.]), relating to state and county <br />planning commissions. This new article (H.B. 1041) provides for the <br />designation and :regulation of areas and activities of "state int:erest". <br /> <br />Section 24-65.1-201, among otheJ: things, st;ates that natural <br />hazard areas are of state interest. Insofar as floodplains are con- <br />cerned, section 202 provides as follows: <br /> <br />"24-65.1-202 (2) (a) Natural hazard areas shall he administered <br />as follows: <br /> <br />(1) Floodplains shall be administE,red so as to minimize signi- <br />ficant hazards to public health and nafety or to property. 'rhe Colo- <br />rado water conservation board shall promulgate a model floodplain <br />regulation no later than September 30, 1974. Open space activities <br />such as agriculture, recreation, and miner:al extraction shall be en- <br />couJ:aged in the floodplains. Any combination of these activities <br />shall be conducted in a mutually compatible manner. Building of <br />structures in the floodplain shall be designed in terms of the avail-. <br />ability of flood protection devices, proposed intensity of use, <br />effects on the acceleration of floodwaters, potential significant <br />hazards to public health and safety or t:o property, and other impact <br />of such development on downstream communit:ies such as the creation of <br />obstructions during floods. Act:ivitles shall be discouraged which, <br />in time of flooding, would create significant: hazards to public health <br />and safety or to property. Shallow 1..,ells, solid waste disposal sites, <br />and septic tanks and sewage disposal systems shall be protected from <br />inundation by floodwaters. . . . <br /> <br />5 <br />
