Number: PDA <br /> <br />STATE OF COLORADO <br />CONSULTANT AGREEMENT <br /> <br />PROJECT NUMBER: <br /> <br />~HIS AGREEMENT.made this :2,13 day of ;M 7 ,in the year 2001 by and between the State of <br />Coiorado, acting by and through the Colorado Water Conservation Board, hereinafter referred to as the <br />Principal Representative, and WRC Enoineerino._hereinafter referred to as the Consuitant. <br /> <br />WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated, and otherwise made <br />available, and a sufficient unencumbered balance thereof remains available for payment in Fund Number <br />JQQ...., Appropriation 5E\L, GBL 41-, Object Code fL:!Q, Contract Encumbrance Number C /,<; tJO(pJ.. <br />and <br /> <br />WHEREAS, required approval, ciearance and coordination has been accomplished from and with <br />appropriate agencies; and <br /> <br />WHEREAS, the Principal Representative intends to obtain enoineerino services to develop and produce <br />deliverabie items reiated to the CWCB's Statewide Prainaoe and Floodplain Manaoement Criteria Manual, <br />hereinafter called the Project; and <br /> <br />WHEREAS, the Consuitant was selected and determined to be the most qualified, and fees negotiated in <br />accordance with the provisions of C.R.S. ~24-30-1401 et seq; and <br /> <br />NOW THEREFORE, it is hereby agreed that <br /> <br />ARTICLE 1. <br /> <br />SCOPE OF WORK <br /> <br />The Consultant, in consideration of State's promises hereinafter made, promises to perform and accomplish <br />all the work and services proposed, and in accordance with the terms and conditions set forth in the scope of <br />services description dated April 25. 2001 , which documents are attached hereto and made a part hereof <br />by reference as Exhibit "A". Consultant shall undertake and perform the necessary work and services as is <br />customarily done in the professional practice of engineering/consulting in the professional community for <br />undertakings of similar character, scope and magnitude. . - <br /> <br />ARTICLE 2. <br /> <br />COMPENSATION <br /> <br />In consideration for the performance of the said work and services, Principal Representative agrees to pay to <br />Consuitant fees and charges not to exceed Fiftv Thousand Dollars ($50,000). The total fees and expenses <br />shall be payable upon completion of the work and services and acceptance by the Principal Representative. <br />Periodic payment shall be made for work completed and invoiced by the consultant. <br /> <br />ARTICLE 3. <br /> <br />CONSULTANT CERTIFICATION <br /> <br />In accordance with Title ~24-30-1404 (1), C.R.S., the Consultant has executed a certificate, Which is attached <br />hereto and made a part hereof by reference as Exhibit "C", stating that wage rates (Exhibit "B") and other <br />factuai unit costs supporting the compensation paid by the State for these professional services are accurate, <br />complete, and current. The original contract price and any additions thereto shall be adjusted to exclude any <br />significant sums by which the State determines the contract price has been increased due to inaccurate, <br />incomplete, or non-current wage rates and other factual unit costs. All such contract adjustments shall be <br />made within one year following the end of this contract. <br />
